Amend the National Health Service Redress Act 2006 to facilitate faster
resolution of claims and reduce costs; and for connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Limit on compensation offered

In section 3 of the NHS Redress Act 2006 (redress under scheme), subsection
(5) is omitted and replaced by—

(5) A scheme that provides for financial compensation to be offered must
5specify an upper limit on the amount of financial compensation that
may be included in an offer under the scheme..

2 Time limits in scheme

(1) In section 4 of the NHS Redress Act 2006 (commencement of proceedings
under scheme), subsection (2)(c) is omitted.

(2) 10In section 6 (proceedings under scheme), subsection (2) (c) is omitted.

(3) After section 6 the following new section is added—

6A Time limits

A scheme must make provision for time limits in relation to—

(a) the commencement of proceedings under the scheme,

(b) 15determination of the offer to be made under the scheme, and

(c) acceptance of an offer of compensation under the scheme..

3 Widening scope of redress scheme

Section 1(6) and section 1(7) of the NHS Redress Act 2006 are hereby repealed.

4 Commencement of 2006 Act

(1) Section 19(4) of the NHS Redress Act 2006 is hereby repealed.

(2) Sections 1 to 16 of the NHS Redress Act 2006 shall come into force on 1 April
2012.

5 5Financial provisions

There shall be paid out of money provided by Parliament—

(a) any expenditure incurred under or by virtue of this Act by a Minister of the
Crown or a government department, and

(b) any increase attributable to this Act in the sums payable under any other Act
10out of money so provided.

6 Short title, commencement and extent

(1) This Act may be cited as the National Health Service Redress (Amendment)
Act 2011.

(2) This Act shall come into force on the day on which it is passed.

(3) 15This Act extends to England and Wales only.
