Use of fraudulent parking badge

To move the following Clause:—

 

‘Anyone found guilty of knowingly using a fraudulent parking badge will receive

 

a minimum custodial sentence of three months.’.

 


 

Misuse of parking badge

‘Anyone found guilty of knowingly allowing another to use their disabled parking

 

badge shall be liable on summary conviction to fine not exceeding level 5 on the

the applicant has completed the necessary paperwork by the authority’s deadline

 

for such paperwork.”.’.

“(6A)    

An issuing authority has a duty to invite members of the badge scheme in writing

 

to renew their membership two months before the badge is due to lapse.”.’.

“(2A)    

The issuing authority must check with the relevant social security office whether

 

or not the person that the badge is being requested for is in receipt of relevant

 

social security payments and notify the social security office if that person is

 

awarded a parking badge.”.’.

“(2B)    

Having been notified by the issuing authority of the award of a parking badge, the

 

relevant social security office is under a duty to notify the issuing authority when

 

entitlement to any disability related benefits ceases.”.’.

Page  2,  line  35  [Clause  3],  at end insert ‘after subsection (2) insert—

 

“(2C)    

Upon notification from the relevant social security office that disability related

 

benefits have ceased, the issuing authority must immediately notify the badge

 

holder that their badge has been cancelled unless—

 

(a)    

in exceptional circumstances, the individual is still entitled to the parking

 

badge on other criteria;

 

(b)    

the badge has less than two weeks until its expiration; or

 

(c)    

the benefit entitlement is the subject of an ongoing appeal.’.
