Payments offered under a contract for difference relating to the supply of

 

electricity generated by nuclear power must not exceed payments offered under

 

any contract for the supply of electricity from renewable sources.

 

(4)    

For the purposes of subsection (3)—

 

(a)    

the calculation of payments must include both the strike price and the

 

duration of the contract;

 

(b)    

renewable sources are defined in accordance with Article 2 of Directive

 

2009/28/EC of the European Parliament and of the Council of 23 April

 

2009 on the promotion of the use of energy from renewable sources.’.

examination and produce a report on the terms of a contract relating to non-

 

nuclear generation.
