Make provision for a graduated driving licence scheme; and for connected
purposes.
Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—
(1) The Road Traffic Act 1988 is amended as follows.
(2) After section 89(2A) (tests of competence to drive) insert—
“(2AA)
No person submitting himself for a test of competence to drive a motor
5vehicle shall be permitted to book an appointment for the test unless he
submits a certificate of completion by him of an approved training
course, signed by an Approved Driving Instructor, with his application
for the test.”
(3) After section 97(3) (grant of licences) insert—
“(3A)
10If the applicant for the licence states that it is made for the purpose of
enabling the applicant to drive a motor vehicle within twelve months
of passing a test of competence to drive, any licence granted in
pursuance of the application shall be a newly-qualified driver’s licence
for that purpose.
(3B)
15A newly-qualified driver’s licence shall be granted where the applicant
has passed a test of competence to drive subject to the following
prescribed conditions—
(a)
the newly-qualified driver’s licence will be valid for 12 months
from the date of issue;
(b)
20a holder of a newly-qualified driver’s licence may carry no
more than one passenger in a vehicle he is driving;
(c)
the level of alcohol in the blood of a person driving while
holding a newly-qualified driver’s licence must not exceed 5
micrograms in 100 millilitres of breath;

(d)
if a holder of a newly-qualified driver’s licence amasses more
than six penalty points the licence will be revoked and the
driver will be required to re-qualify under the tests of
competence specified in section 89 (tests of competence to
5drive).
(3C)
At the end of the twelve month period the newly-qualified driver’s
licence holder may apply for a full driving licence subject to—
(a)
submission of a prescribed certificate of completion by him of
further tests of competence, signed by an Approved Driving
10Instructor. The competencies shall include motorway driving
and night time driving and such other competencies as the
Secretary of State may by order from time to time specify;
(b)
the period of the applicant’s newly-qualified driver’s licence
not having been extended by the police as a result of his
15commission of any traffic offence.”
(4)
In section 11(2) (interpretation of sections 4 to 10), after ““the prescribed limit”
means, as the case may require—” insert—
in the case of the holder of a newly-qualified driver’s
licence 5 micrograms in 100 millilitres of breath,”.
(1) This Act may be cited as the Graduated Driving Licence Scheme Act 2013.
(2)
This Act will come into force on such day as the Secretary of State may by order
appoint
(3) This Act does not extend to Northern Ireland.
