TO

Make provision to make provision to exclude from the United Kingdom
foreign nationals found guilty of a criminal offence committed in the United
Kingdom.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Exclusion from the United Kingdom

(1) The Secretary of State must make provision in regulations for any foreign
national convicted in any court of law of a qualifying offence to be excluded
from the United Kingdom.

(2) 5Regulations shall provide for—

(a) the removal of an individual excluded under subsection (1) from the
United Kingdom, where this is not already provided for in law,

(b) the removal of any right to remain in the United Kingdom from an
individual excluded under subsection (1), and

(c) 10measures to prevent an individual excluded under subsection (1) from
entering the United Kingdom.

(3) Regulations under this section shall be—

(a) made by statutory instrument, and

(b) may not be made unless a draft has been laid before and approved by
15resolution of either House of Parliament.

(4) In this section—

2 Short title and commencement

(1) This Act may be cited as the Foreign National Offenders (Exclusion from the
United Kingdom) Act 2013.

(2) This Act comes into force on whatever day the Secretary of State appoints by
5order made by statutory instrument.
