TO
Facilitate the transfer of asylum seekers to the safe country nearest their
country of origin.
Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—
(1)
The Secretary of State must make provision in regulations for any foreign
national claiming asylum in the United Kingdom to be transferred to the safe
country nearest their country of origin.
(2)
5Regulations shall provide for the transfer of an individual under subsection (1)
from the United Kingdom, where this is not already provided for in law.
(3) Regulations under this section shall be—
(a) made by statutory instrument, and
(b)
may not be made unless a draft has been laid before and approved by
10resolution of either House of Parliament.
(4) In this section—
“asylum seeker” shall mean a person who claims that to remove him from
or require him to leave the United Kingdom would breach the United
Kingdom‘s obligations under the Convention Relating to the Status of
15Refugees done at Geneva on 28 July 1951 and its Protocol.
“safe country” shall mean a country included in Schedule 3 of the Asylum
and Immigration (Treatment of Claimants etc.) Act 2004.

20Act 2013.
(2)
This Act comes into force on whatever day the Secretary of State appoints by
order made by statutory instrument.
