Make provision to allow smoking in a separate ventilated room in a private
members’ club if a majority of the members of the club so decide.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Amendment of the Health Act 2006

(1) Section 3 (smoke-free premises: exemptions) of the Health Act 2006 is amended
as follows.

(2) Leave out subparagraph (3)(b).

2 5Decision by club members

If the majority of members of a club qualifying for a club premises certificate
within the meaning of section 60 of the Licensing Act 2003 decide that smoking
should be allowed, the club shall provide a separate, ventilated room for that
purpose.

3 10Short title and commencement

(1) This Act may be cited as the Smoking (Private Members’ Clubs) Act 2013.

(2) This Act comes into force at the end of the period of 2 months beginning with
the day on which it is passed.
