Make provision for the removal of provisions in planning regulations relating
to Gypsies and Travellers.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Removal of provisions

(1) In section 38 of the Planning and Compulsory Purchase Act 2004 after
subsection 4 insert—

(4A) A development plan may not contain special provision for Gypsies and
5Travellers.

(2) Section 225 of the Housing Act 2004 is repealed.

(3) In this section—

  • “Gypsies and Travellers” means—

    (a)

    persons with a cultural tradition of nomadism or of living in a
    10caravan; and

    (b)

    all other persons of a nomadic habit of life, whatever their race
    or origin, including—

    (i)

    such persons who, on grounds only of their own or their
    family’s or dependant’s educational or health needs or
    15old age, have ceased to travel temporarily or
    permanently; and

    (ii)

    members of an organised group of travelling
    showpeople or circus people (whether or not travelling
    together as such).

2 20Short title, extent and commencement

(1) This Act may be cited as the Planning Regulations (Removal of Provisions in
Respect of Gypsies and Travellers) Act 2013.

(2) This Act applies to England and Wales only.

(3) This Act shall come into force two months after Royal Assent.
