Require police forces to register hate crimes committed against people with
learning difficulties and learning disabilities including autism; and for
connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Hate crime: provision of information by chief officers of police

After section 44 of the Police Act 1996, there is inserted—

44A Hate crime: provision of information by chief officers of police

(1) A chief officer of police of any police force must establish and maintain
5a register of hate crimes committed against people with learning
difficulties or learning disabilities.

(2) A chief officer of police of any police force must provide the Secretary
of State with a copy of the register of hate crimes under subsection (1)
on such dates as shall be specified by order by the Secretary of State.

(3) 10The register under subsection (1) may, in particular, specify
information in the form of statistical data, being data connected with—

(a) the policing of that police area, or

(b) the discharge of the national or international functions of the
police force for that area.

(4) 15The Secretary of State must by order specify the form in which
information under subsection (1) is to be collected and registered.

(5) The Secretary of State may require a chief officer to publish, in such
manner as appears to the Secretary of State to be appropriate,
information provided in accordance with a requirement under
20subsection (1).

(6) The Secretary of State may cause a consolidated and classified abstract
of any information in the form of statistical data that is provided in

accordance with subsection (1) to be prepared and laid before
Parliament.

(7) The Secretary of State must by order made by statutory instrument
specify the learning difficulties or learning disabilities required to be
5registered pursuant to subsection (1), such specification to include
autism.

2 Orders and regulations

(1) Any power to make an order or regulations under this Act is exercisable by
statutory instrument.

(2) 10A statutory instrument containing an order under section 1 may not be made
unless a draft of the instrument has been laid before and approved by a
resolution of each House of Parliament.

3 Short title, commencement and extent

(1) This Act may be cited as the Hate Crime (People with Learning Difficulties and
15Learning Disabilities) Act 2014.

(2) This Act comes into force at the end of the period of 2 months beginning with
the day on which it is passed.

(3) This Act extends to England and Wales only.
