| In subsection (1)(b), leave out ‘and (ii) is living in a household in the United |

| Kingdom with the child,’. |

| In subsection (2)(b), leave out ‘if, as a result, no relevant parent or carer would remain |

| in the United Kingdom’ and insert— |
|
| | ‘(c) | parents must only be separated from children where this is necessary for |

| | the purposes of child protection.’. |

| Page 2, line 35, at end insert the following new Clause:— |
|
| | ‘Restrictions on detention of unaccompanied children |
|
| | |
| | (1) | An unaccompanied child shall not be detained under Immigration Act powers. |
|
| | (2) | “unaccompanied child” means a person— |
|
| | (a) | who is under the age of 18, and |
|
| | (b) | who is not accompanied whilst in detention, by his or her parent or |
|
| | another individual who has care of him or her.’. |
|
| |
| | |
| As an Amendment to the Lords Amendment:— |
|

| | |
|
| At end add ‘, and confirms that the best interests of a child in the United Kingdom |
|
| continue to be a primary consideration in all cases involving childen.’. |
