to investigate a complaint that the Board or a clinical commissioning

 

group has failed to comply with the regulations;

 

(b)    

to investigate, on the regulator’s initiative, whether the Board or a clinical

 

commissioning group has failed to comply with the regulations;

 

(c)    

to require a person to provide such information as the regulator may

 

specify for the purposes of an investigation.

 

(4B)    

Before making regulations under subsection (4), the Secretary of State must

 

consult such persons as the Secretary of State considers appropriate.”
