Fixed Odds Betting Terminals (Betting Shops) Bill (HC Bill 38)

TO

Require the Secretary of State to create a new planning use class for betting
shops with fixed odds betting terminals, which would require the granting of
planning permission; to provide that local planning authorities assess demand
for fixed odds betting terminal betting shops when considering applications
for premises in that planning use class and place a cap on the number of such
shops for which planning permission may be granted in any area; and for
connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Betting shops with fixed odds betting terminals (separate planning class)

(1) The Town and Country Planning (Use Classes) Order 1987 is amended as
follows.

(2) In the Schedule, Part A, after the words “consumption off the premises”, there
5is inserted—

Class A4. Betting Offices with fixed odds betting terminals.

Use for the provision of a betting office with fixed odds betting
terminals where services are provided principally to visiting
members of the public.

2 10Betting shops with fixed odds betting terminals (planning permission)

(1) In considering whether to grant planning permission for any use of the
planning class established under section 1, a local planning authority must take
into account local demand for betting shops of a kind described in that section.

(2) A local planning authority must place a cap on the total number of such betting
15shops in its area which at any one time will be granted planning permission.

(3) A local planning authority must have regard to the cap mentioned in
subsection (2) when considering any application for planning permission for
any use of the planning class established by section 1.

3 Interpretation

5In this Act “local planning authority” has the meaning given in Part 1 of the
Town and Country Planning Act 1990.

4 Short title, commencement and extent

(1) This Act may be cited as the Fixed Odds Betting Terminals (Betting Shops) Act
2015.

(2) 10This Act comes into force on the day after it is passed.

(3) This Act extends to England only.
