BILL

TO

Prohibit the sale of electronic cigarettes to persons under the age of 18; and for
connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Prohibition of electronic cigarette advertisement

The provisions of the Tobacco Advertising and Promotion Act 2002 shall apply
to electronic cigarettes as they do to tobacco products and all references to
tobacco products in that Act shall be read as if they were references to
5electronic cigarettes.

2 Prohibition of sale of electronic cigarettes to persons under the age of 18

(1) The Secretary of State shall, as soon as possible, and no later than 12 months
from the coming into force of this Act, make regulations under section 92 of the
Children and Families Act 2014 for the purpose of prohibiting the sale of
10electronic cigarettes to persons under 18.

(2) The Secretary of State may consult such persons as the Secretary of State thinks
appropriate on the details of such regulations prior to publication.

3 Interpretation

In this Act “electronic cigarette” means an electronic device manufactured for
15the purpose of administering nicotine by means of inhalation of an aerosol
substance.

4 Short title and commencement

(1) This Act may be cited as the Electronic Cigarettes (Advertising and Legal Age
of Purchase) Act 2015.

(2) 20This Act comes into force on the date of Royal Assent.
