TO

Make provision about the recording of the names of the mother of each party
to a marriage or civil partnership for registration purposes; to make provision
for requiring such information to be displayed on marriage certificates and
civil partnership certificates; and for connected purposes.

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

1 Marriage certificate particulars

(1) The Marriage Act 1949 is amended as follows.

(2) After section 56 of that Act, insert—

56A Particulars to be requested, recorded and displayed

(1) 5The Secretary of State shall, after public consultation, make regulations
setting out the particulars to be—

(a) requested under section 56;

(b) registered under section 55(1); and

(c) displayed on any copy of a registration made under section
1055(1) (a “marriage certificate”) provided to any person.

(2) The particulars mentioned in subsection (1)(a), (b) and (c) shall include
but need not be limited to—

(a) the name (prior to the marriage) and date of birth of each party
to the marriage;

(b) 15the name and occupation of the mother of each party to the
marriage, if known; and

(c) the name and occupation of the father of each party to the
marriage, if known.”

2 Civil partnership: required information

(1) 20The Civil Partnership Act 2004 is amended as follows.

(2) After section 2(4) of that Act, insert—

(4A) Information required under subsection (4) shall include but need not be
limited to—

(a) the names and date of birth of each party to the civil
5partnership;

(b) the name and occupation of the mother of each party to the civil
partnership, if known; and

(c) the name and occupation of the father of each party to the civil
partnership, if known.

(4B) 10The particulars in subsection (4A) shall be recorded on—

(a) any formal central register or record of civil partnerships legally
entered into, and

(b) any certificate or other formal statement drawn up as an
expressionof the facts in a particular case registered under
15subsections paragraph (a).”

3 Short title, commencement and extent

(1) This Act may be cited as the Marriage and Civil Partnership Registration
(Mothers’ Names) Act 2016.

(2) This Act comes into force on the day after the day it receives Royal Assent.

(3) 20This Act extends to England and Wales.
