Parliamentary approval for financial costs or for charges imposed
870 The additional expenditure arising from the Bill is subject to a Money Resolution. Parliament will be asked to agree that any expenditure arising from this Bill (should it become an Act) incurred by a member of the government will be taken out of money supplied by Parliament.
871 There is potential expenditure by the Secretary of State and by other publicly funded bodies under the Bill. In particular, there is power under paragraph 9 of Schedule 12 for the Secretary of State to make payments to the Information Commissioner. Also, government departments which are controllers in relation to the processing of personal data may incur costs in complying with the new data protection regime. The provisions of the bill may lead to increases in public expenditure under other Acts, for example where publicly funded bodies established under other Acts incur costs in complying with the new regime.
872 A ways and means resolution is not required for the Bill. (A ways and means resolution is required where a bill authorises new charges on the people – broadly speaking, new taxation or other similar charges.) The provision in clauses 137 and 138 for charges payable to the Information Commissioner by controllers reproduces provision in sections 108 to 110 of the Digital Economy Act 2017, which has already been authorised by a ways and means resolution (on 26 April 2017).
