Require the Prime Minister to revoke the notification, under Article 50(2) of
the Treaty on European Union, of the United Kingdom’s intention to
withdraw from the European Union unless two conditions are met; to
establish as the first condition for non-revocation that a withdrawal agreement
has been approved by Parliament by 21 January 2019 or during an extension
period agreed by that date under Article 50(3) of the Treaty on European
Union; to establish as the second condition for non-revocation that a majority
of participating voters have voted in favour of that agreement in a referendum
in which the United Kingdom remaining as a member of the European Union
was the other option; and for connected purposes.
Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—

Duty to revoke notification of withdrawal from EU if withdrawal agreement
condition not met
(1)
Unless the withdrawal agreement condition is met, the Prime Minister must
immediately inform the European Council that the United Kingdom revokes
5its notification to withdraw from the European Union under Article 50(2) of the
Treaty on European Union.
(2)
For the purposes of this section, the “specified date” is 21 January 2019 or the
day after the day on which this Act is passed, whichever is earlier.
(3) The withdrawal agreement condition is met if—
(a)
10a withdrawal agreement has been approved by Parliament under
section 13 of the European Union (Withdrawal) Act 2018 by the
specified date, or
(b)
an extension period agreed under Article 50(3) of the Treaty on
European Union is in place.

Duty to revoke notification of withdrawal from EU if referendum condition
not met
(1)
The provisions of this section apply if a withdrawal agreement has been
approved by Parliament in accordance with section 13 of the European Union
5(Withdrawal) Act 2018.
(2) In this section, “referendum condition day” is whichever is sooner of—
(a)
90 days after the day on which the approval in subsection (1) was
granted, and
(b)
the day after the day on which a referendum is held in which the two
10options are—
(i)
to agree the withdrawal agreement referred to in subsection (1),
and
(ii)
the United Kingdom remaining as a member of the European
Union.
(3)
15On referendum condition day, unless the referendum condition is met, the
Prime Minister must inform the European Council that the United Kingdom
revokes its notification to withdraw from the European Union under Article
50(2) of the Treaty on European Union.
(4)
The referendum condition is met if a majority of participating voters have
20voted in favour of the option referred to in subsection (2)(b)(i) in a referendum
in which the United Kingdom remaining as a member of the European Union
was the other option.
3 Repeals
If the duty of the Prime Minister under either section 1(1) or section 2(3) is
25engaged the following Acts are repealed-

European Union (Notification of Withdrawal) Act 2017;

European Union (Withdrawal) Act 2018;

Haulage Permit and Trailer Registration Act 2018;
-
Taxation (Cross-Border Trade) Act 2018;
-
30Nuclear Safeguards Act 2018;
-
Sanctions and Anti-Money Laundering Act 2018.
4 Commencement, extent and short title
(1) This Act comes into force on the day on which it is passed.
(2)
Any repeal made by this Act has the same extent as the provision to which it
35relates.
(3)
This Act may be cited as the European Union (Revocation of Notification of
Withdrawal) Act 2019.
