Insert the following new Clause—

“Role of Mayor’s Office for Policing and Crime in appointments

The Commissioner of Police of the Metropolis shall ensure that the Mayor’s Office for Policing and Crime shall have the opportunity to interview all candidates being considered for appointment under sections 46, 47 and 48 and to make recommendations to him about such candidates before he consults the Mayor’s Office for Policing and Crime in accordance with sections 46(2), 47(2) and 48(2).”

Clause 63

Leave out Clause 63 and insert the following new Clause—

“Acting police and crime commissioner

(1) Where a police and crime commissioner is unable to perform their functions under this Part, the relevant police and crime panel must appoint an acting police and crime commissioner who is—

(a) a member of that police and crime panel; and

(b) a member of the relevant local authority.

(2) A person who is appointed to the role of acting police and crime commissioner under subsection (1) has the same powers and is subject to the same requirements as a police and crime commissioner, in accordance with this Act and any other enactment.

(3) In appointing an acting police and crime commissioner under subsection (1), the relevant police and crime panel must stipulate the maximum length of time that the person may hold that position.

(4) A person ceases to hold the position of acting police and crime commissioner—

(a) in the event that the police and crime commissioner is able to resume their functions under this Act;

(b) at the end of the maximum term stipulated by the police and crime panel; or

(c) as otherwise stipulated in this Act or any other enactment.”

Clause 79

[As an amendment to Baroness Browning’s amendment to insert a new clause: Policing Protocol after Clause 79]

 

At end insert—

“( ) The policing protocol must, in particular, provide that if a chief constable, Commissioner of the Metropolis, or Deputy Commissioner of the Metropolis resigns or is required to resign before the expiry of his term of appointment, HMIC must conduct a review of the reasons for that resignation and publish a report on that review.

( ) In conducting that review, HMIC may call upon the assistance of IPCC, if the reason for the resignation is or appears to be one which is related to the ethical conduct of any party to whom the protocol applies.

( ) A statutory instrument containing an order under this section may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament.”
