                   LORDS AMENDMENT 1

  Lord Freud to move, That this House do not insist on its Amendment 1 to

which the Commons have disagreed.

BARONESS MEACHER

As an amendment to the above motion at end to insert

“but do propose the following amendment in lieu—

 

Page 4, line 34, at end insert—

 

“such additional amount to be paid at a higher rate, a middle rate or a lower

 

rate. The middle rate shall be no less than two-thirds of the higher rate as

 

may be prescribed. The lower rate shall be no less than one third of the

 

higher rate”.”

  Lord Freud to move, That this House do not insist on its Amendment 73 to

 

which the Commons have disagreed.

 

  LORD BOSWELL OF AYNHO

As an amendment to the above motion at end to insert

“but do propose the following amendment in lieu—

 

Page 101, line 27, at end insert—

 

“In section 6 of the Child Maintenance and Other Payments Act 2008

 

(provision to allow charging of fees by the Commission) after subsection (2)

 

there is inserted—

 

“(2A) Regulations under subsection (1) may make provision for

 

adjustment of fees—

 

(a) in cases where the parent with care has taken reasonable

 

steps to establish whether it is possible or appropriate to

 

make a maintenance agreement (within the meaning of

 

section 9 of the Child Support Act) and, where having taken

 

such reasonable steps, it is either not possible or not

 

appropriate for the parent with care to do so, or

 

(b) in order to prevent significant diminution of the total

 

revenue available to the parent with care for the

 

maintenance of their child.

 

(2B) Regulations may make provision for the transfer of all or some of

 

the obligation to pay fees between the parties concerned.

 

(2C) Regulations may make any other provision for the waiver or

 

abatement of fees in circumstances where the Secretary of State
