Insert the following new Clause—

“Road traffic accident: damages

(1)     In a claim for damages for negligence or breach of statutory duty arising
from a road traffic accident, the court may not award damages in respect of
personal injury if the person alleged to have been negligent or in breach of
statutory duty has demonstrated a generally responsible approach by
either funding treatment or agreeing to fund treatment for the claimant’s
injuries.

(2)     This section only applies where a claimant injured in a road traffic accident
suffers a loss of function of 15% or less as a result of that accident.”
