“(2) After subsection (2) (which imposes a general duty with respect to health
and safety on self-employed persons) insert—
“(2A) Nothing in subsection (2) shall preclude the Secretary of State from
making regulations exempting self-employed persons carrying out
certain activities from the provisions of section 3(2) or from
specified regulations thereunder where it can be shown that their
work activities pose no potential risk of harm to others.””
