After Clause 1
BARONESS MEACHER
Insert the following new Clause—
(1) The Secretary of State must conduct an impact assessment of the Republic
of Ireland’s Criminal Justice (Psychoactive Substances) Act 2010.
(2) The Secretary of State must publish a report setting out whether or not the
impact assessment under subsection (1) justifies the commencement of this
Act in its current form.”
Insert the following new Clause—
Following the commencement of this Act, the Secretary of State must
publish a report annually setting out the impact of this Act, including on
deaths and other harms caused by all controlled and banned substances.”

Page 2, line 10, at end insert—
“(2A) The Secretary of State must add a substance to Schedule 1 under subsection
(2)(a) if it is deemed to pose low health, social and safety risks.
(2B) A substance is deemed to pose low health, social and safety risks under
subsection (2A) if it is so determined by an independent committee
comprising experts nominated by the Royal College of Psychiatrists, the
British Pharmacological Society and the Academy of Medical Sciences.”

“( ) For the purposes of this section, patrons of entertainment establishments
and those responsible for health and social care services and prisons are
exempt from liability for their clients’ use of psychoactive substances on
their premises within the meaning of this Act.”

“(1) This section comes into force on the day on which this Act is passed.”
Page 33, line 12, at end insert—
“( ) The Secretary of State may not make regulations under subsection (2) until
she has published a report under section (Republic of Ireland: impact
assessment).”
