After Clause 15

Insert the following new Clause—

“Universal credit standard allowance: single claimants under the age of 25 who
are care leavers and lone parents

(1)     The standard allowance payable to a single person under the age of 25 shall
be that same higher rate of standard allowance that is payable to a single
person aged 25 or over where the single person under 25 is both—

(a)   a care leaver, and

(b)   a lone parent.

(2)     In this section—

“care leaver” means a person eligible to claim universal credit and to
whom a duty to provide leaving care services or support is owed
under the Children Act 1989, as amended;

“lone parent” means a person with responsibility for a dependent
child or children, with that child or children being in their primary
care.

(3)     The Secretary of State shall, by regulation, establish an appeals process by
which an individual can appeal a decision as to whether the provisions of
this section apply in their individual situation.”

“( )     After subsection (11) insert—

“( )     Kinship carers are exempted from the benefit cap if the kinship
carer concerned is caring for a child and—

(a)   is responsible for the child but is not the child’s parent or
step-parent and

(b)   has undertaken to look after the child because the child—

(i)   has no parents or has parents who are unable to care
for the child; or

(ii)   would likely be otherwise looked after by the local
authority because of concerns about the child’s
welfare.””
