provide for a review by the Secretary of State of the regulations governing
gamete storage periods.

e it enacted by the Queen’s most Excellent Majesty, by and with the advice and
consent of the Lords Spiritual and Temporal, and Commons, in this present
Parliament assembled, and by the authority of the same, as follows:—
1 Review of regulations
(1)
The Secretary of State must conduct a review of the law of the United Kingdom
relating to the statutory storage period for gametes.
(2)
The review must in particular consider amending the current regulations to
5permit the extension of the storage period to over ten years for those who
express that they have not completed their family (and such proposed
amendments are set out in the Schedule).
(3)
The Secretary of State must begin the review before the end of the period of six
months beginning with the day on which this Act is passed.
(4)
10 The Secretary of State must lay before both Houses of Parliament a report of the
conclusions of the review and of any proposals which it makes.
(5)
The Secretary of State must lay before both Houses of Parliament a report
about the progress of the review—
(a)
before the end of the period of six months beginning with the day on
15which the review began, and
(b)
before the end of each further period of six months beginning with the
day of the most recent progress report, until the report of the review is
laid before both Houses of Parliament in accordance with subsection
(4).
2 20Extent and short title
(1) This Act extends to England and Wales, Scotland and Northern Ireland.
(2) This Act may be cited as the Storage Period for Gametes Act 2020.

SCHEDULE
Section 1
Proposed amendments to existing regulations for gamete storage periods

The Human Fertilisation and Embryology (Statutory Storage Period for
Embryos and Gametes) Regulations 2009 (S.I 2009/1582) are proposed to be
5amended as follows.

In Regulation 4(1)(b), after “subparagraph (b)” insert “or expression was
made under sub-paragraph (c)”.

In Regulation 4(2), after “sub-paragraph (b)” insert “or expression made
under sub-paragraph (c)”.
4 10In Regulation 4, leave out paragraph (3) and insert—
“(3) The circumstances referred to in paragraph (2) are that—
(a)
the person who provided the gamete in question has
consented in writing to the gamete being stored for a
period in excess of ten years for the provision of treatment
15services; and either
(b)
on any day within the relevant period a registered medical
practitioner has given a written opinion that the person
who provided the gamete or, where they are not that
person, the person to be treated, is infertile or is likely to
20become prematurely infertile; or
(c)
on any day within the relevant period the person who
provided the gamete or, where they are not that person,
the person to be treated, has expressed that they have not
yet completed their family.”
