The House met at half-past Two o'clock.

PRAYERS.

1    Medway Council Bill [Lords],-The House proceeded to consider the Lords Reason for disagreeing to the Commons Amendment to the Medway Council Bill [Lords], in page 4, line 23, to leave out from 'business' to 'enter' in line 24.

    Resolved, That this House does not insist on its Amendment to which the Lords have disagreed.-(Mr Paul Clark.)

2    Elections Bill,-Mr Secretary Straw, supported by the Prime Minister, Mr Chancellor of the Exchequer, Mr Secretary Prescott, Mr Secretary Murphy, Mr Secretary Reid and Mr Mike O'Brien, presented a Bill to postpone local elections in England and Wales and Northern Ireland, to require polls for different elections in Northern Ireland to be taken together if they are to be taken on the same day, and to make consequential provision: And the same was read the first time; and ordered to be read a second time to-morrow and to be printed [Bill 80].

    Ordered, That the Explanatory Notes relating to the Elections Bill be printed [Bill 80-EN].

3    Graffiti (Control),-Ordered, That leave be given to bring in a Bill to prohibit the sale of spray paint to minors; to authorise local authorities to require people subject to community service orders to undertake the removal of graffiti; and for connected purposes: And that Dr Jenny Tonge, Dr Vincent Cable, Mr Edward Davey, Mr Paul Burstow and Mr Tom Brake do prepare and bring it in.

4    Graffiti (Control) Bill,-Dr Jenny Tonge accordingly presented a Bill to prohibit the sale of spray paint to minors; to authorise local authorities to require people subject to community service orders to undertake the removal of graffiti; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 20th July and to be printed [Bill 81].

5     Business of the House,-A Motion was made, and the Question being put, That, in respect of the Elections Bill, notices of Amendments, new Clauses and new Schedules to be moved in Committee may be accepted by the Clerks at the Table before the Bill has been read a second time-(Mr Charles Clarke);

    The House divided.

    So the Question was agreed to.

6    International Criminal Court Bill [Lords],-The International Criminal Court Bill [Lords] was, according to Order, read a second time.

7    International Criminal Court Bill [Lords] (Programme),-A Motion was made, and the Question being proposed, That the following provisions shall apply to the International Criminal Court Bill [Lords]:

Standing Committee

    1. The Bill shall be committed to a Standing Committee.

    2. The Standing Committee shall have leave to sit twice on the first day on which it shall meet.

    3. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Thursday 3rd May.

Consideration and Third Reading

    4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion at Nine o'clock on the day on which those proceedings are commenced or, if that day is a Thursday, at Six o'clock on that day.

    5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at Ten o'clock on the day on which those proceedings are commenced or, if that day is a Thursday, at Seven o'clock on that day.

    6. Sessional Order B (Programming Committees) made by the House on 7th November 2000 shall not apply to proceedings on consideration and Third Reading.

Lords messages

    7. Paragraphs (6) and (7) of Sessional Order A (varying and supplementing programme motions) made by the House on 7th November 2000 shall not apply to proceedings on any motion to vary or supplement this order for the purpose of allocating time to proceedings on consideration of any messages from the Lords, and the question on any such motion shall be put forthwith-(Mr John Battle);

    And it being three-quarters of an hour after the commencement of proceedings on the Motion, the Deputy Speaker put the Question, pursuant to Order [7th November].

8    International Criminal Bill [Lords] [Money],-Her Majesty's Recommendation having been signified to the proposed Motion relating to International Criminal Bill [Lords] Bill [Money];

    A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the International Criminal Court Bill [Lords], it is expedient to authorise-

    (a) the payment out of money provided by Parliament of any expenditure of the Secretary of State incurred in consequence of the Act;

    (b) the payment out of such money or the Consolidated Fund of sums in respect of contributions or benefits in respect of judicial pensions arising in connection with the appointment of the holder of a United Kingdom judicial office as a judge of the International Criminal Court;

    (c) the payment out of money provided by Parliament of any increase attributable to the Act in the sums payable out of money so provided under any other Act-(Mr David Jamieson):-It was agreed to.

9    Christmas Day (Trading) Bill [Money],-Her Majesty's Recommendation having been signified to the proposed Motion relating to Christmas Day (Trading) Bill [Money];

    A Motion was made, and the Question being proposed, That, for the purposes of any Act resulting from the Christmas Day (Trading) Bill, it is expedient to authorise the payment out of money provided by Parliament of any increase attributable to the Act in the sums so payable under any other Act-(Mr Mike O'Brien);

    And it being three-quarters of an hour after the commencement of proceedings on the Motion, the Deputy Speaker put the Question, pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills):-It was agreed to.

10    Local Government,-A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the draft Relevant Authorities (General Principles) Order 2001, which was laid before this House on 26th March, be approved-(Mr David Clelland):-It was agreed to.

11    Local Government Finance,-A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the Local Government Finance (England) Special Grant Report (No. 79) on School Standards, Support of Educational Budgets and Costs of Transitional Funding (House of Commons Paper No. 355), which was laid before this House on 26th March, be approved-(Mr David Clelland):-It was agreed to.

12    Constitutional Law,-A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the draft Scottish Parliament (Elections etc.) (Amendment) Order 2001, which was laid before this House on 27th March, be approved-(Mr David Clelland):-It was agreed to.

13    Social Security,-A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the draft Social Security (Breach of Community Order) Regulations 2001, which were laid before this House on 20th March, be approved-(Mr David Clelland);

    And the Deputy Speaker's opinion as to the decision of the Question being challenged, the Division was deferred till to-morrow, pursuant to Order [7th November].

14    Adjournment (Easter),-A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 25 (Periodic adjournments), That this House, at its rising on Tuesday 10th April, do adjourn till Monday 23rd April-(Mr David Clelland):-It was agreed to.
