1    Message from the Lords,—A Message was brought from the Lords, as follows:

The Lords agree to the Medway Council Bill, without Amendment.

2    Balance Charitable Foundation for Unclaimed Assets (Allocation) Bill,—The Order for reading the Balance Charitable Foundation for Unclaimed Assets (Allocation) Bill a second time on Friday 15th October was read and discharged.

Bill withdrawn.

3    Foundation for Unclaimed Assets Bill,—The Order for reading the Foundation for Unclaimed Assets (Allocation) Bill a second time on Friday 15th October was read and discharged.

4    Local Land Charges (Fees) Bill,—The Order for reading the Local Land Charges (Fees) Bill a second time on Friday 15th October was read and discharged.

5    Rite of Passage (Welcoming and Coming of Age),—Ordered, That leave be given to bring in a Bill to establish Civil Welcoming Ceremonies, Responsibility to Children Agreements and Coming of Age Ceremonies; to make provision as to their conduct; and for connected purposes: And that Mr Frank Field, Ross Cranston, Mrs Ann Cryer, Ms Meg Munn, Mr David Kidney, Mr David Willetts, Tony Wright, Mrs Louise Ellman, Alice Mahon and Angela Eagle do prepare and bring it in.

6    Rite of Passage (Welcoming and Coming of Age) Bill,—Mr Frank Field accordingly presented a Bill to establish Civil Welcoming Ceremonies, Responsibility to Children Agreements and Coming of Age Ceremonies; to make provision as to their conduct; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 15th October and to be printed [Bill 160].

7    Civil Partnership Bill [Lords],—The Order of the day being read, for the Second Reading of the Civil Partnership Bill [Lords];

And a Motion being made, and the Question being put, That the Bill be now read a second time; The House divided.

So the Question was agreed to.

8    Civil Partnership Bill [Lords] (Programme),—A Motion was made, and the Question being put forthwith pursuant to Orders [28th June 2001 and 6th November 2003 (Programming of Bills)], That the following provisions shall apply to the Civil Partnership Bill [Lords]:

Committal

1. The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

2. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on 21st October 2004. 3. The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced. 5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

Programming Committee

6. Sessional Order B (programming committees) made on 28th June 2001 shall not apply to proceedings on consideration and Third Reading.

Programming of proceedings

7. Any other proceedings on the Bill (including any proceedings on consideration of Lords Amendments or on any further messages from the Lords) may be programmed—(Jim Fitzpatrick); The House divided.

9    Civil Partnership Bill [Lords] [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Civil Partnership Bill [Lords] [Money];

A Motion was made, and the Question being put forthwith pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Civil Partnership Bill [Lords], it is expedient to authorise— (1) the payment out of money provided by Parliament of—

      (a) any expenditure incurred under or by virtue of the Act by a person holding office under Her Majesty or by a government department, and

      (b) any increase attributable to the Act in the sums payable under any other Act out of money so provided, and

(2) the payment out of the Consolidated Fund of any increase attributable to the Act in the sums payable under any other Act out of that Fund—( Jim Fitzpatrick):—It was agreed to.

10    Mental Capacity Bill (Programme) (No. 2),—A Motion was made, and the Question being put forthwith pursuant to Orders [28th June 2001 and 6th November 2003 (Programming of bills)], That the programme Order of 11th October 2004 in relation to the Mental Capacity Bill be amended by the substitution in paragraph 2 (time for conclusion of proceedings in Standing Committee) for the words '28th October' of the words '4th November'—( Jim Fitzpatrick):—It was agreed to.

11    Legal Services,—A Motion was made, and the Question being put forthwith pursuant to Standing Order No. 118 (Standing Committees on Delegated Legislation), That the draft Legal Services Complaints Commissioner (Maximum Penalty) Order 2004, which was laid before this House on 8th July, be approved—(Jim Fitzpatrick):—It was agreed to.

12    Section 5 of the European Communities (Amendment) Act 1993,—Ordered, That, for the purposes of their approval under section 5 of the European Communities (Amendment) Act 1993, the Government's assessment as set out in the Budget 2004 shall be treated as if it were an instrument subject to the provisions of Standing Order No. 118 (Standing Committees on Delegated Legislation).—( Jim Fitzpatrick.)

13    Public Petitions,—A Public Petition from the family and friends of Natalie McCabe, Vicky Browne and Rebecca Fish, and others, for legislation to increase the penalties for driving offences, to require the display of a valid driving licence and insurance documents in the windscreens of vehicles and to create a separate category of offence for drivers who cause injury or death while driving without a licence was presented and read; and ordered to lie upon the Table and to be printed.
