5    European Standing Committee B,—Mr Mike Hancock reported from European Standing Committee B the following Resolution:

    That the Committee takes note of European Union Document No. 14223/04, public consultation document on the creation of a Fundamental Rights Agency; and supports the Government's position as set out in its response of 10th January 2005, namely that the focus of the Agency should be upon compliance by the institutions of the European Union with human rights, and that the Agency's primary purpose should be data collection and analysis.

6    Renewable Energy Bill [Lords],—Ordered, That the Renewable Energy Bill [Lords] be read a second time on Friday 15th April.

7    Education Bill [Lords],—The Education Bill [Lords] was, according to Order, read a second time.

8    Education Bill [Lords] (Programme),—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 83A (Programme motions), That the following provisions shall apply to the Education Bill [Lords]:

Committal

    1. The Bill shall be committed to a Standing Committee.

Proceedings in Standing Committee

    2. Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Thursday 14th April 2005.

    3. The Standing Committee shall have leave to sit twice on the first day on which it meets.

Consideration and Third Reading

    4. Proceedings on consideration shall (so far as not previously concluded) be brought to a conclusion one hour before the moment of interruption on the day on which those proceedings are commenced.

    5. Proceedings on Third Reading shall (so far as not previously concluded) be brought to a conclusion at the moment of interruption on that day.

Programming Committee

    6. Standing Order No. 83B (Programming committees) shall not apply to proceedings on consideration and Third Reading.

9    Education Bill [Lords] [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Education Bill [Lords] [Money];

    A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Education Bill [Lords], it is expedient to authorise—

    (1) the payment out of money provided by Parliament of—

      (a) any expenditure incurred by the Secretary of State under the Act, and

      (b) any increase attributable to the Act in the sums which by virtue of any other Act are payable out of money provided by Parliament, and

22    Fisheries: Total Allowable Catch Quotas in 2005 and 2006,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Documents No. 15390/04, draft Council Regulation fixing for 2005 and 2006 the fishing opportunities for Community fishing vessels for certain deep sea stocks, and No. 15237/04, draft Council Regulation fixing for 2005 the fishing opportunities and associated conditions for certain fish stocks and groups of fish stocks, applicable in Community waters and, for Community vessels, in waters where catch limitations are required; and supports the Government's objective of achieving the conservation and sustainable exploitation of fishing resources in line with the precautionary principle whilst preserving a viable degree of activity for the industry—(Mr Nick Ainger):—It was agreed to.

23    Third Railway Package,—A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 119 (European Standing Committees), That this House takes note of European Union Documents No. 7170/04, Commission Communication: further integration of the European rail system, No. 7147/04, draft Directive amending Council Directive 91/440/EEC on the development of the Community's railways, No. 7172/04, Commission staff working paper: draft Directive amending Directive 91/440/EEC on the development of the Community's railways to gradually open up the market for international passenger services by rail, No. 7149/04, draft Regulation on international rail passengers' rights and obligations, No. 7148/04, draft Directive on the certification of train crews operating locomotives and trains on the Community's rail network, and No. 7150/04, draft Regulation on compensation in cases of non-compliance with contractual quality requirements for rail freight services; and endorses the Government's approach to continuing discussions in Council in order to secure practical, proportionate and cost effective legislation aimed at developing the Community single rail area—(Mr Nick Ainger):—It was agreed to.
