Magistrates Courts

Mr. Boateng : To ask the Parliamentary Secretary, Lord Chancellor's Department what plans he has in respect of the appointment of chief justices' clerks to magistrates courts committees.

Mr. John M. Taylor : The Government's intention is that every magistrates courts committee should appoint a legally qualified head of service and that the Lord Chancellor's approval should be required for each such appointment.

Such an appointment will provide clearer lines of accountability within the service, and also yield improvements in the efficiency and effectiveness of the service's management.

Mr. Boateng : To ask the Parliamentary Secretary, Lord Chancellor's Department what plans he has to empower the Lord Chancellor to enforce the amalgamation of magistrates courts committee areas.

Mr. John M. Taylor : The Police and Magistrates' Courts Bill currently before Parliament proposes that the Lord Chancellor should have the power to initiate amalgamations between magistrates courts committee areas. An amalgamation order may only be made after consultation with the local magistrates, the magistrates courts committees concerned and all local authorities in the affected area.

Mr. John M. Taylor : As announced in this House on 2 February, the Lord Chancellor has listened to the criticism of the Police and Magistrates' Courts Bill voiced in the House of Lords on 18 January. He proposes to move an amendment when the Bill next comes before Parliament, the effect of which will be to remove the proposed requirement that the Lord Chancellor approve the appointment of magistrates courts committee chairmen.

Justices' Clerks

Mr. Boateng : To ask the Parliamentary Secretary, Lord Chancellor's Department what plans the Lord Chancellor has to require that all justices' clerks be put on fixed-term contracts.

Mr. John M. Taylor : As announced in this House on 2 February, the Lord Chancellor has listened to the criticism of the Police and Magistrates' Courts Bill voiced in the second reading debate in the House of Lords on 18 January. He proposes to move an amendment when the Bill next comes before Parliament, the effect of which will be to remove the proposed power of the Lord Chancellor to require that any contract of service made between a magistrates court committee and a chief justices' clerk or justices' clerk must contain such provision as my be specified in the order.

Crown Courts (Racial Bias)

Lady Olga Maitland : To ask the Parliamentary Secretary, Lord Chancellor's Department how many complaints he has received in his last recorded year over alleged racial bias by (a) Crown court judges, (b) Crown court recorders and (c) Crown court magistrates.

Mr. John M. Taylor : According to the information which is readily available, during 1993 no complaints were received in which a specific allegation of racial bias by individual members of the judiciary or magistracy sitting in the Crown court formed the sole or substantive grounds of complaint (but two such complaints, one against two circuit judges and one against a recorder, initially received in 1992, were dealt with in 1993). This does not include any complaints received in 1993 about proceedings in the Crown court in which imputed or alleged racial prejudice by the courts may have been an element in, or seen as relating to, the grounds of complaint, but which cannot be separately identified or quantified.

Parliamentary Questions

Mr. Rooker : To ask the Parliamentary Secretary, Lord Chancellor's Department if he will list those topics on which it is not his practice to answer parliamentary questions ; and if he will list any recent changes in the practice of his Department.

Mr. John M. Taylor : There has been no change from the practice of this and previous Administrations, as described on page 292 of the current edition of "Erskine May".

HOME DEPARTMENT

Hostels, West Midlands

Ms Short : To ask the Secretary of State for the Home Department how many staff are expected to be made redundant in the event of the closure of hostels in the west midlands area ; and what would be the financial costs.

Dr. Lynne Jones : To ask the Secretary of State for the Home Department how many staff will be made redundant in the event of the closure of hostels in the west midlands area ; and what would be the financial costs.

Mr. Maclean : It will be for the probation committee as employer to decide how to manage the consequences of closures in terms of staff redeployment or redundancy ; we have not yet received full accounts of their conclusions.

Ms Short : To ask the Secretary of State for the Home Department what was the occupancy rate of hostels in the west midlands area for each of the last 10 quarters.

Mr. Maclean : Occupancy figures for the period April 1991 to March 1992 are not readily available on a quarterly basis. The occupancy figures for the most recently available six quarters and for December 1993 are as follows :

Ms Short : To ask the Secretary of State for the Home Department following the proposed closure of hostels in the west midlands area, what advice will be given to the magistrates courts regarding any future bail hostel remands.

Dr. Lynne Jones : To ask the Secretary of State for the Home Department what advice will be given to the magistrates courts regarding any future bail hostel remands following the closure of bail hostels in the west midlands.

Mr. Maclean : There are alternative hostel facilities in the west midlands and in neighbouring probation areas ; and it will be for the probation service to bring them to the attention of the courts.

Ms Short : To ask the Secretary of State for the Home Department who will be consulted about the proposed closure of hostels in the west midlands area.

Mr. Maclean : The west midlands probation service was notified on 1 December of our closure proposals and given the opportunity to comment.

Ms Short : To ask the Secretary of State for the Home Department what was (a) the average cost of a weekly place in hostels in the west midlands area, (b) the average length of stay and (c) the average cost of a prison remand place in the west midlands area.

Mr. Maclean : (a) The average weekly cost in 1993-94 is £243 ; (b) this information is not readily available in the form requested ; (c) costs for remand prisoners are not kept separately. For 1992-93, the average weekly net operating cost per prisoner at Birmingham prison, the only prison in the west midlands, was £383. Remand prisoners represent just over 40 per cent. of these prisoners.

Ms Short : To ask the Secretary of State for the Home Department what capital expenditure was planned for hostels in the west midlands area prior to his Department's statement of 30 November.

Dr. Lynne Jones : To ask the Secretary of State for the Home Department if any capital expenditure was planned for hostels in the west midlands area prior to the Home Office statement of 30 November.

Mr. Maclean : A number of proposals for capital expenditure on west midlands hostels had been received prior to the 30 November statement, but none had or have yet been approved.

Ms Short : To ask the Secretary of State for the Home Department how many residents of hostels in the west midlands area were (a) aged under 17 years, (b) 17 to 21 years and (c) 21 years and over at the most recent available date.

Mr. Maclean : For the period January to December 1993, (a) none, (b) 368, (c) 713.

Ms Short : To ask the Secretary of State for the Home Department what capital and revenue expenditure will be available for hostel provision in the west midlands area for 1994-95 and 1995-96.

Dr. Lynne Jones : To ask the Secretary of State for the Home Department what capital and revenue expenditure will be available for hostel provision in the west midlands area for 1994-95 and 1995-96.

Mr. Maclean : Revenue grant for approved bail and probation/bail hostels in the west midlands for 1994-95 and 1995-96 will be approximately £1.5 million a year. The amount of capital grant available for hostels in this area will depend on the strength of bids submitted by the probation committee in comparison to those for hostels in other areas.

Ms Short : To ask the Secretary of State for the Home Department what he expects to be the annual saving as a result of the closure of hostels in the west midlands area.

Mr. Maclean : We expect the saving to be in the order of £0.2 million in 1994-95 and £0.4 million in 1995-96.

Ms Short : To ask the Secretary of State for the Home Department how many persons were (a) re-arrested and charged or (b) breached for failure to comply with requirements at hostels in the west midlands area for the latest period for which statistics are available.

Bewsey Street Hostel, Cheshire

Parole

Mr. Milburn : To ask the Secretary of State for the Home Department how many occasions a licensed firearms or shotgun holder has committed (a) homicide or (b) serious injury with a gun in each of the last 10 years.

Public Bodies

Mr. Kilfoyle : To ask the Secretary of State for the Home Department who are the members currently appointed to the Police Advisory Board.

Mr. Charles Wardle : The constitution of the board stipulates that the board shall consist of :

(a) the Secretary of State, who shall be the Chairman thereof, and such persons as he may from time to time direct to serve thereon ; (

(b) the Association of County Councils, the Association of Metropolitan Authorities, the Association of Chief Police Officers of England and Wales, the Police Superintendents's Association of England and Wales, and the Commissioner of Police of the Metropolis. It is for the authorities and bodies listed above to decide who should represent them on the board.
