Mrs. Ann Taylor: To ask the Secretary of State for Education and Employment what legal advice she has received on the consultation process following the application by Castle Hall grant-maintained schools' Mirfield to admit pupils over the age of 16 years. [39319]
Mr. Paice: I wrote on 18 July to the head teacher in reply to his letter regarding the status of their application. As a result of legal advice I informed him that the application could not be considered due to inadequate consultation. I therefore invited the governors to withdraw their proposals and resubmit them in compliance with the regulations. The governors have now written withdrawing their proposals.
Ms Glenda Jackson: To ask the Secretary of State for Education and Employment if she will list the number of traffic violations involving departmental vehicles, the nature of the violations, and the total amount of fines arising from those violations, in each year since 1986. [39310]
Mr. Robin Squire: The driver is responsible for any fines and penalties incurred while driving a DFEE vehicle. Not all traffic violations are notified to the Department. Where violations have been notified, details are kept on vehicle specific files and no central records are maintained.
Mr. Barnes: To ask the Secretary of State for Education and Employment on how many occasions ministerial conference and meeting rooms in the parliamentary estate have been booked in her name, or that of other Ministers in her Department, for meetings with Conservative hon. Members immediately preceding questions to her Department in the current parliamentary Session. [39520]

Mr. Robin Squire: Ministers have meetings with honourable Members as and when necessary to discuss a wide variety of matters. Records are not kept which would enable the distinction on the type of meeting to be drawn.
Sir Graham Bright: To ask the Secretary of State for Education and Employment how many school days were lost by children as a result of asthma in the last year for which figures are available. [39558]
Mr. Robin Squire: This information is not collected centrally. Information on levels of authorised and unauthorised absence is collected annually in respect of all day pupils of compulsory school age, but schools are not required to break their authorised absence totals down by cause of absence.
Mr. Rooker: To ask the Secretary of State for Education and Employment if she will publish her decisions regarding the bids entered by local education authorities for the schools renewal challenge fund. [39784]

Mr. Neil Hamilton: To ask the Secretary of State for Education and Employment when she proposes to publish the employment code of practice under the Disability Discrimination Act 1995; and if she will make a statement. [40008]
Mr. Paice: We will be publishing the employment code of practice tomorrow and a copy will be placed in the Library.
The code of practice, which has now been approved by Parliament, will come into force on 2 December, the same day that the employment provisions will be commenced. The code gives practical guidance through a wide range of examples to illustrate how employers and others can comply with the employment provisions, although the action required in any given situation will depend on the particular circumstances. By publishing the code now we are giving employers, and others affected by the employment provisions time to familiarise themselves with its guidance and take whatever action they wish in order to prepare for implementation of the new duties and rights.
As well as the printed version, the code will also be available in braille and on audio cassette tape. All formats will be available through Her Majesty's Stationery Office outlets.

My right hon. Friend has received a number of representations about capital funding in higher education and the role of the PFI. She has set up two working groups to consider the issues, and they are expected to report soon.
