10. We consider that the following raises questions of political importance, but make no recommendation for its further consideration:-

(17799) 12054/96 COM(96)623 Amended proposal for a European Parliament and Council Directive amending Directive 92/50/EEC relating to the co-ordination of procedures for the award of public service contracts, Directive 93/36/EEC co-ordinating procedures for the award of public supply contracts, and Directive 93/37/EEC concerning the co-ordination of procedures for the award of public works contracts.

Legal base: Article 57(2), 66 and 100a; co-decision; qualified majority voting.

Background

    10.1  The aim of the proposal is to ensure that EC rules on the awarding of public contracts are no less favourable to EC providers than the rules of the Government Procurement Agreement (GPA) are to GPA signatories outside the EC.

    10.2  We reported on 4 December[24] on a Supplementary Explanatory Memorandum in which the Economic Secretary to the Treasury (Mrs Knight) informed us of progress in negotiations on the two draft Directives on which we had first reported on 12 July 1995[25]. The present document is the Commission's revised proposal containing the changes on which we reported in December. In an Explanatory Memorandum dated 31 January, the Treasury tells us that it limits amendments to EC legislation to those which are necessary to achieve compatibility with the GPA.

Conclusion

    10.3  We repeat our earlier conclusion that the issues raised are of political importance, but do not recommend a debate.
