Amend the Water Industry Act 1991 to prohibit the use by water undertakers of rateable values as a basis for charging from 31st March 1998; to provide for charging by water undertakers in accordance with council tax bands; and for connected purposes.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Charging by reference to council tax bands.     1. - (1) Section 145 of the Water Industry Act 1991 shall be amended in accordance with subsections (2) and (3) below.
 
      (2) In subsection (2)(a), for "2000" there shall be substituted "1998".
 
      (3) After subsection (2) there shall be inserted-
 
 
    "(2A) All occupiers of premises who are required to pay for services for the period including 31st March 1998 by a charges scheme that makes reference to a rating valuation list shall, from 1st April 1998, have their charges scheme replaced by a scheme based on the council tax band valuation of the premises, as fixed by a valuation under the Local Government Finance Act 1992.
 
      (2B) Nothing in this section shall affect the right of any person to require a meter to be used in determining the amount of charges for water by volume, in accordance with section 148 below.".
 
Short title and extent.     2 - (1) This Act may be cited as the Water Charges (Amendment) Act 1998.
 
      (2) This Act extends to England and Wales only.
