SCHEDULE 1
 
  CONSEQUENTIAL AMENDMENTS
     1. The 1991 Act shall be amended as follows.
 
     2. - (1) Section 103 shall be amended as follows.
 
      (2) In subsection (1), for the words "take into consideration the question of making a declaration" there shall be substituted the words "make a declaration".
 
     3. - (1) Section 105 shall be amended as follows.
 
      (2) For subsection (1), there shall be substituted-
 
 
    "(1) An owner of any sewer or sewage disposal works may appeal to the Secretary of State if he is aggrieved by-
 
 
    (a) the refusal of a sewerage undertaker to make a declaration under section 102 above; or
 
    (b) the fact that the date of vesting specified in a declaration made under section 102 is more than six months from the date of the declaration".
      (3) For subsection (3) there shall be substituted-
 
 
    "(3) The time for the making of an appeal under subsection (1) above by the owner of any sewer or sewage disposal works shall be any time after receipt of notice of the undertaker's refusal or, if no such notice is given, at any time after the end of two months from the making of the application for the declaration."
 
      (4) For paragraph (a) of subsection (4) there shall be substituted-
 
 
    "(a) in the case of an appeal under subsection (1) above, allow or disallow the decision of the sewerage undertaker or, as the case may be, specify a date of vesting to be noted in the declaration which the sewerage undertaker has made;".
