MINOR AND CONSEQUENTIAL AMENDMENTS ABOUT ASSEMBLY |
| The Exchequer and Audit Departments Act 1866 (c.39) |
| 1. At the end of section 3 of the Exchequer and Audit Departments Act 1866 (tenure of Comptroller and Auditor General) insert- "But a person may at the same time hold both the office of Comptroller and Auditor General and the office of Auditor General for Wales." |
| The Statutory Instruments Act 1946 (c.36) |
| 2. In section 1 of the Statutory Instruments Act 1946 (document by which a power conferred on a Minister of the Crown and expressed to be exercisable by statutory instrument is exercised to be known as a statutory instrument), after subsection (1) insert- |

"(1A) The references in subsection (1) to a Minister of the Crown shall be construed as including references to the National Assembly for Wales." |

| The Public Records Act 1958 (c.51) |
| 3. - (1) The First Schedule to the Public Records Act 1958 (definition of public records) is amended as follows. |

(2) In paragraph 2(1)(a) (records of, or held in, any department of Her Majesty's Government in the United Kingdom), after "the United Kingdom" insert "or the National Assembly for Wales". |

(3) In Part II of the Table in paragraph 3 (certain establishments whose records are public records) insert at the appropriate place- "Auditor General for Wales." |
| The Pensions (Increase) Act 1971 (c.56) |
| 4. In Schedule 2 to the Pensions (Increase) Act 1971 (official pensions), after paragraph 3B insert- |

| 8. In section 163 of the Copyright, Designs and Patents Act 1988 (Crown copyright), after subsection (1) insert- |

"(1A) For the purposes of this section, works made by Her Majesty include any sound recording, film, live broadcast or live cable programme of the proceedings of the National Assembly for Wales (or of a committee of the Assembly or a sub-committee of such a committee) which is made by or under the direction or control of the Assembly; but a work shall not be regarded as made by or under the direction or control of the Assembly by reason only of its being commissioned by or on behalf of the Assembly." |

| The European Communities (Amendment) Act 1993 (c.32) |
| 9. In section 6 of the European Communities (Amendment) Act 1993 (which provides that a person may be proposed for membership of the Committee of the Regions constituted under Article 198a of the Treaty establishing the European Community only if he is an elected member of a local authority), before "an elected member of a local authority" insert "a member of the National Assembly for Wales or". |
| The Health Service Commissioners Act 1993 (c.46) |
| 10. The Health Service Commissioners Act 1993 has effect subject to the following amendments. |
| 11. In section 8(2)(a) (authorities not entitled to make a complaint), at the end insert "(including the National Assembly for Wales)". |
| 12. - (1) Section 14 (reports by Commissioners) is amended as follows. |

(2) After subsection (2D) insert- |
|
|
"(2E) In any case where the Health Service Commissioner for Wales conducts an investigation pursuant to a complaint under section 3(1), (1A) or (1C) he shall also send a report of the results of the investigation to any member of the National Assembly for Wales who to the Commissioner's knowledge assisted in the making of the complaint (or if he is no longer a member to such other member as the Commissioner thinks appropriate). |

(2F) In any case where the Health Service Commissioner for Wales decides not to conduct an investigation pursuant to a complaint under section 3(1), (1A) or (1C) he shall also send a statement of his reasons to any such member of the National Assembly for Wales as is mentioned in subsection (2E). |

(2G) In any case where the Commissioner involved is the Health Service Commissioner for Wales, subsections (1)(e), (2A)(f) and (2C)(f) have effect as if the references to the Secretary of State were references to the National Assembly for Wales." |

(3) After subsection (4) insert- |
|
|
"(4A) Where the Health Service Commissioner for Wales lays a report before each House of Parliament under subsection (3) or (4), he shall also lay the report before the National Assembly for Wales." |
