| Block exemptions |
| 3. - (1) The Secretary of State may, at any time before the commencement date, make one or more orders for the purpose of providing block exemptions which are effective on that date. |
|
(2) An order under this paragraph has effect as if it were properly made under section 6. |
| Duty of Director to take proceedings |
| 4. - (1) The Director is no longer under the duty imposed by section 1(2)(a) of the RTPA to compile and maintain a register of agreements but may continue to do so before the commencement date. |
|
(2) In relation to agreements made after the enactment date, the Director is no longer under the duty to take proceedings imposed by section 1(2)(c) of the RTPA but may continue to do so. |
|
(3) In relation to agreements made after the enactment date, section 21 of that Act has effect as if subsections (1) and (2) were omitted. |
| Continuing proceedings |
| 5. - (1) For the purposes of this Schedule, "continuing proceedings" means proceedings in respect of an application which is made to the Court under the RPA or the RTPA, but is not determined- |
|
(a) in the case of proceedings under the RPA, before the date of enactment; and |
|
(b) in the case of proceedings under the RPTA, before the commencement date. |
|
(2) On the date of enactment, continuing proceedings under the RPA shall automatically be stayed for a period of two years from that date or until such earlier time as they are discontinued under sub-paragraph (3) or (7). |
|
(3) On the commencement date, continuing proceedings under the RPA which are stayed by virtue of sub-paragraph (2) shall automatically be discontinued. |
|
(4) The repeals made by section 1 do not affect continuing proceedings. |
|
(5) Proceedings on an application for an order under section 16 or 17 of the RPA are continuing proceedings if- |
|
(a) leave to make the application was applied for before the commencement date; and |
|
(b) the proceedings in respect of that application for leave were continuing proceedings. |
|
(6) If proceedings under the RTPA are continuing as a result of this section, a person falling within section 4(3) of the RTPA may apply to the Court for the proceedings to be discontinued. |
|
(7) If proceedings under the RPA are continuing as a result of this section, a person falling within section 15 of the RPA may apply to the Court for the proceedings to be discontinued. |
|
(8) If, on an application under sub-paragraph (6) or (7), the Court orders the proceedings in question to be discontinued, this Schedule is to have effect from the date on which the proceedings are discontinued as if they had never been instituted. |
