TO

Amend the Wildlife and Countryside Act 1981 to require the owners and occupiers of land notified as sites of special scientific interest who commit an offence under section 28 of the Act to restore that interest of the site lost, damaged or degraded as a result of the offence or offences.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Amendment of the Wildlife and Countryside Act 1981.     1. - (1) The Wildlife and Countryside Act 1981 shall be amended as follows.
 
      (2) In section 28, for the word "damage" in subsection (4)(b) there shall be substituted "destroy or damage".
 
      (3) In section 31-
 
 
    (a) for "section 29" in subsection (1) there shall be substituted "section 28 or 29", and
 
    (b) after subsection (1) there shall be inserted-
 
    "(1A) Where subsection (1) of this section applies and it is not reasonably practicable to restore the land to its former condition, then the court by which the person is convicted may, in addition to dealing with him in any other way, make an order requiring him to carry out within such period as may be specified in the order, such operations for the purpose of restoring the land to a condition specified in the order as it sees fit, provided that the court has satisfied itself that any such order is both reasonable and practical in the circumstances of the case.".
 
Citation and extent.     2. - (1) This Act may be cited as the Restoration of Damage to Sites of Special Scientific Interest Act 1998.
 
      (2) This Act extends to England and Wales only.
