Clause

Amend the law relating to the names of public houses; and for related purposes.
BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

Consent required for change of name of public house.     1. - (1) Section 20 of the Licensing Act 1964 is amended as set out in this section.

    (2) In subsection (2), after paragraph (c), there is inserted-

"(d) in the case of a public house, changes the name of the public house which is displayed on any model, sign, placard or board outside the premises, or any device or representation relating to that name which is so displayed;".

    (3) After subsection (2), there is inserted the following subsection-

    "(2A) Before considering an application for their consent under subsection (1)(d) above, the licensing justices shall consult the local planning authority.".

    (4) In subsection (6), after paragraph (b), there is inserted-

"(c) "local planning authority" shall be construed in accordance with Part I of the Town and Country Planning Act 1990.".

    (5) After subsection (6), there is inserted the following subsection-

    "(6A) For the avoidance of doubt, a change to the name of a public house under subsection (1)(d) above shall include the display of any additional name, whether or not the original name is still displayed.".

Short title.     2. This Act may be cited as the Public House Names Act 1997.
