B I L L TO Provide for the representation of Gibraltar by a Member of Parliament, subject to limitations, in the Parliament of the United Kingdom of Great Britain and Northern Ireland; for the inclusion of Gibraltar in a European parliamentary constituency; for the right of the chief minister to petition the House of Commons at the bar of the House; and for related purposes. BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:- | |
Election of a Member of Parliament for Gibraltar. | 1. - (1) On the same day as a parliamentary election is held in the United Kingdom, registered electors in Gibraltar may vote in an election for a Member of the House of Commons of the Parliament of Great Britain and Northern Ireland who shall be known as the Member of Parliament for Gibraltar. |
(2) Any vacancy for the position of Member of Parliament for Gibraltar occurring between general elections shall be filled in the same manner as a vacancy occurring in a constituency in England or Wales. | |
Rules for the conduct of elections and the remuneration of the Member of Parliament for Gibraltar. | 2. - (1) Rules governing the conduct of elections arising under section 1, together with the scale of allowances and other emoluments for the elected Member of Parliament for Gibraltar, shall be set out in regulations made by the Secretary of State. |
(2) Regulations made under subsection (1) shall be enacted and enforced by the House of Assembly of Gibraltar. | |
Entitlement of the Member of Parliament for Gibraltar to take part in proceedings of the House. | 3. The Member of Parliament for Gibraltar shall be entitled to take part only in those proceedings of the House which the Speaker certifies as- |

but shall not be entitled to vote on any matter. | |
Elections to the European Parliament. | 4. - (1) For the purposes of European parliamentary elections held in the United Kingdom- |

(2) The European parliamentary electoral region in England in which electors in Gibraltar shall be entitled to vote shall be nominated in regulations made by the Secretary of State which shall be subject to- | |

(3) Regulations made under subsection (2) may also make provision for the administrative arrangements and rules governing the conduct of elections arising under subsection (1). | |
Right of the Chief Minister of Gibraltar to petition the House of Commons. | 5. The Chief Minister of Gibraltar shall have the right on application to the Speaker to petition at the bar of the House of Commons. |
Short title and commencement. | 6. - (1) This Act may be cited as the Representation of Gibraltar at Westminster and in the European Union Act 1998. |
(2) This Act shall not come into force until the approval of the people of Gibraltar has been given in a referendum. | |
(3) Once the conditions of subsection (2) have been satisfied, the House of Assembly of Gibraltar may by resolution activate the provisions of this Act in whole or in part. |
