The House met at half-past Two o'clock.

PRAYERS.

1Writ issued during the Adjournment,—The Speaker acquainted the House that, during the Adjournment, she had issued a warrant to the Clerk of the Crown to make out a new Writ for the electing of a Member to serve in this present Parliament for the Burgh Constituency of Paisley South in the room of Gordon McMaster, Esquire, deceased.

2Controverted Elections (Winchester, Election Petition),—The Speaker acquainted the House, That she had received the following Certificate and Report from the Judges appointed to try the Election Petition relating to the Election for Winchester:

”To the Right Honourable the Speaker of the House of Commons

Election of a Member of Parliament for the Constituency of Winchester held on the 1st day of May 1997

In the Matter of a Petition relating to the said Election presented to Her Majesty's High Court of Justice on the 15th day of May 1997

Between Gerald Malone Petitioner, and Mark Oaten and Lindsay Garrett Fox Respondents We the Right Honourable Lord Justice Brooke and the Honourable Mr Justice Gage do hereby certify in accordance with the provisions of section 146(2) of the Representation of the People Act 1983 that on the 6th day of October 1997 a trial of the Petition herein in the form of a Special Case was heard before us, sitting as a Divisional Court of the Queen's Bench Division, and that our determination is set out in the sealed copy of the Order of the Court dated the 6th day of October 1997 annexed hereto dated this 9th day of October 1997

Monday the 6th day of October 1997, In the High Court of Justice, Queen's Bench Division, Divisional Court, In the Matter of the Representation of the People Act 1983 and in the Matter of a Parliamentary Election for the Constituency of Winchester held on the 1st day of May 1997

Between Gerald Malone Petitioner, and Mark Oaten and Lindsay Garret Fox Respondents

Upon reading the Petition of the above named Petitioner presented the 15th day of May 1997

And upon reading the Notice of Motion dated the 23rd day of September 1997 on behalf of the Petitioner for an Order that the Case raised by the said Petition be stated as a Special Case

And a Special Case having been agreed and signed by Counsel on behalf of the Petitioner and the Respondents

And upon reading the Affidavit of David Hamilton Cowan sworn the 30th day of July 1997 and the exhibits referred to therein, the Report of the Prescribed Officer dated the 25th day of July 1997 and the Agreed Special Case

And upon hearing Mr Richard Price QC on behalf of the Petitioner, Mr David Pannick QC and Miss Helen Mountfield of Counsel on behalf of the first Respondent, Mr Timothy Straker QC on behalf of the second Respondent and Mr Mark Harris of Counsel on behalf of the Director of Public Prosecutions

And the Court having directed that the Case raised by the Petition be stated as a Special Case and that this hearing be treated as the substantive hearing of the Special Case and proceeding to hear the same forthwith

The Court applying the provisions of section 23 of the Representation of the People Act 1983 determined and declared that

(i) there were breaches by the Returning Officer's agents of Rules 20 and 37 of the Parliamentary Elections Rules in Schedule 1 to the said Act in that 54 or 55 ballot papers were issued to voters without bearing the official mark

(ii) although the election was conducted substantially in accordance with the law as to elections, the result was affected by the above breaches of the said Rules

(iii) the first Respondent, Mark Oaten, was not duly elected and returned as a Member of Parliament for the Constituency of Winchester and the election held on 1 May 1997 was void

And it is ordered that the Petition be allowed accordingly and that the second Respondent do pay to the Petitioner and to the first Respondent their costs of this Petition and of the Special Case herein, such costs to be taxed if not agreed

And it is further ordered that the sum of £5,000 (five thousand pounds) paid into Court by the said Petitioner as security for costs be paid out to the Petitioner's Solicitor together with the interest if any accrued thereon”

And the said Certificate and Order of the Court were ordered to be entered in the Journal of the House.

3Disqualification of a Member,—The Speaker laid upon the Table a notification, That Mr Chancellor of the Exchequer had on 21st October appointed Piers Rolf Garfield Merchant, Esquire, Member for Beckenham, to the office of Steward or Bailiff of Her Majesty's Manor of Northstead in the County of York.

4Message from the Lords,—A Message was brought from the Lords, as follows:

The Lords have agreed to the Ministerial and other Salaries Bill, without Amendment.

Nuclear Explosions (Prohibition and Inspections) Bill [Lords],—The Lords have passed a Bill, intituled, An Act to enable effect to be given to certain provisions of the Comprehensive Nuclear-Test-Ban Treaty adopted in New York on 10th September 1996 and the Protocol to that Treaty; and for connected purposes; to which the Lords desire the concurrence of this House.

Fossil Fuel Levy Bill [Lords],—The Lords have passed a Bill, intituled, An Act to amend section 33 of the Electricity Act 1989; to which the Lords desire the concurrence of this House.

Chronically Sick and Disabled Persons (Amendment) Bill [Lords],—The Lords have passed a Bill, intituled, An Act to amend section 2 of the Chronically Sick and Disabled Persons Act 1970 in respect of the duty of local authorities to make arrangements to meet the needs of chronically sick and disabled persons; to which the Lords desire the concurrence of this House.

Geneva Conventions (Amendment) Bill [Lords],—The Lords have passed a Bill, intituled, An Act to amend the Geneva Conventions Act 1957 to enable criminal proceedings to be taken in the United Kingdom for breach of article 3 of the Conventions; to which the Lords desire the concurrence of this House.

Parliamentary Privilege,—The Lords propose, pursuant to their Message of 31st July, that the Joint Committee on Parliamentary Privilege do meet on Tuesday 18th November at Eleven o'clock in Committee Room 4.

5Nuclear Explosions (Prohibition and Inspections) Bill [Lords],—The Nuclear Explosions (Prohibition and Inspections) Bill [Lords] was read the first time; and ordered to be read a second time to-morrow and to be printed [Bill 63].

6Fossil Fuel Levy Bill [Lords],—The Fossil Fuel Levy Bill [Lords] was read the first time; and ordered to be read a second time to-morrow and to be printed [Bill 64].

7Parliamentary Privilege,—Ordered, That so much of the Lords Message [this day] as relates to the Joint Committee on Parliamentary Privilege be now considered.

So much of the Lords Message considered accordingly.

Ordered, That the Committee appointed by this House do meet the Lords Committee as proposed by their Lordships.

7Special Immigration Appeals Commission Bill [Lords] [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Special Immigration Appeals Commission Bill [Lords] [Money];

A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Special Immigration Appeals Commission Bill [Lords], it is expedient to authorise the payment out of money provided by Parliament of any expenses of a Minister of the Crown incurred in consequence of the Act—(Ms Bridget Prentice):—It was agreed to.
