The House met at half-past Two o'clock.

PRAYERS.

1Police Bill,—Ordered, That the Examiners of Petitions for Private Bills do examine the Police Bill with respect to the applicability thereto of the Standing Orders relating to Private Business.

2Royal Assent,—The Deputy Speaker notified the House, in accordance with the Royal Assent Act 1967, That Her Majesty had signified her Royal Assent to the following Act, agreed upon by both Houses:

Public Processions (Northern Ireland) Act 1998.

3Human Rights Bill [Lords],—The Order of the day being read, for the Second Reading of the Human Rights Bill [Lords];

Mr Secretary Straw acquainted the House, That he had it in Command from the Queen to acquaint the House that Her Majesty, having been informed of the purport of the Bill, has consented to place Her prerogative and interest, so far as they are affected by the Bill, at the disposal of Parliament for the purposes of the Bill.

A Motion was made, and the Question being proposed, That the Bill be now read a second time;

An Amendment was proposed to the Question, to leave out from the word ‘That' to the end of the Question and add the words ‘this House, while confirming its strong belief in human rights, expresses its deep concern at the constitutional implications and deficiencies of the Human Rights Bill [Lords] because the Bill weakens one of the foundations of everyone's human rights and fundamental freedoms, which is an effective political democracy; because the Bill creates in the United Kingdom an additional separate, and potentially incompatible, constitutional framework; because the Bill fails adequately to respect and maintain the principle of separation of powers between the executive, legislative, and judiciary fundamental in a democratic society and will therefore lead to a further increase in the power of the executive, the diminution of Parliament, and the politicisation of the judiciary; and declines to give the Bill a Second Reading', instead thereof.—(Sir Brian Mawhinney.)

4Human Rights Bill [Lords] [Money],—Her Majesty's Recommendation having been signified to the proposed Motion relating to Human Rights Bill [Lords] [Money];

A Motion was made, and the Question being put forthwith, pursuant to Standing Order No. 52 (Money resolutions and ways and means resolutions in connection with bills), That, for the purposes of any Act resulting from the Human Rights Bill [Lords], it is expedient to authorise—

(a) the payments out of money provided by Parliament of any expenses incurred by a Minister of the Crown—

(i) in consequence of an award of damages or costs in proceedings under the Act;

(ii) as administrative expenses resulting from the provisions of the Act;

(iii) in connection with judicial training;

(b) the payment out of such money or the Consolidated Fund of sums in respect of any additional judicial salary, or of contributions or benefits in respect of judicial pensions, arising in connection with the appointment of the holder of a judicial office as a judge of the European Court of Human Rights;

(c) the payment out of money provided by Parliament of any increase attributable to the Act in the sums payable out of money so provided under any other enactment—(Mr David Clelland):—It was agreed to.

5Northern Ireland Grand Committee,—Ordered, That—

(1) the draft Appropriation (Northern Ireland) Order 1998 be referred to the Northern Ireland Grand Committee; and

(2) at the sitting on Thursday 26th February the Committee shall consider, pursuant to Standing Order No. 115, the instrument referred to it under paragraph (1) above.— (Mr David Clelland.)

6Public Petitions,—A Public Petition from residents of Mid-Bedfordshire against building new homes in the countryside or Green Belt was presented and read; and ordered to lie upon the Table and to be printed.

7Adjournment,—A Motion was made, and the Question being proposed, That this House do now adjourn—(Mr David Clelland);

5School Buses (Safety) Bill,—Mr Malcolm Bruce accordingly presented a Bill to introduce safety regulations for school buses; and for connected purposes: And the same was read the first time; and ordered to be read a second time on Friday 20th March and to be printed [Bill 122].

6Iraq,—A Motion was made, and the Question being proposed, That this House condemns the continuing refusal of Iraq to comply with its obligations under the relevant post-ceasefire UN Security Council Resolutions, by allowing UNSCOM to carry out without restrictions the required inspections of its chemical, biological and nuclear weapons programmes; believes that these programmes represent a continuing threat to international peace and stability; fully supports the efforts of the Government to reach a diplomatic solution to the present confrontation with Iraq within the framework of these Security Council Resolutions; and expresses its full support also for the resolve of the Government to use all necessary means to achieve an outcome consistent with these Resolutions—(Mr Secretary Cook);

The Question was amended, in line 8, by leaving out from the word ‘Resolutions' to the end of the Question and adding the words ‘fully supports the resolve of the Government to use all necessary means to achieve an outcome consistent with these Resolutions; and emphasises the importance of setting the clearest possible objectives linked to any action that might be taken' instead thereof.—(Mr Michael Howard.)

And the Main Question, as amended, being put;

Resolved, That this House condemns the continuing refusal of Iraq to comply with its obligations under the relevant post-ceasefire UN Security Council Resolutions, by allowing UNSCOM to carry out without restrictions the required inspections of its chemical, biological and nuclear weapons programmes; believes that these programmes represent a continuing threat to international peace and stability; fully supports the efforts of the Government to reach a diplomatic solution to the present confrontation with Iraq within the framework of these Security Council Resolutions; fully supports the resolve of the Government to use all necessary means to achieve an oucome consistent with these Resolutions; and emphasises the importance of setting the clearest possible objectives linked to any action that might be taken.

Local Government (Experimental Arrangements) Bill,—The Lords have passed a Bill, intituled, An Act to enable local authorities to operate experimental arrangements with respect to the way in which they take decisions, including arrangements with respect to elected mayors and the discharge of functions by single members of authorities; to provide for periodic reviews by local authorities of their decision-making arrangements; and for connected purposes; to which the Lords desire the concurrence of this House.
