Letter from Director-General, DGIII, European Commission to the Clerk of the House

The Commission's services understand that the proposed Order aims inter alia at permitting certain manufacturers, installers and repairers, approved by the Minister, to conduct self verification instead of mandatory verification carried out by an inspector of weights and measures.

The Commission's services take the view that the proposed order is notifiable under directive 83/189/EEC.

Indeed, the term "technical specification" set out in Article 1 § 2 of this directive covers, inter alia, "the requirements applicable to the product as regards...testing and test methods...and conformity assesssment procedures". There can be no doubt that the determination of the person carrying out and being responsible for the testing and for the checking the conformity (first-, second- or third-party-certification), is clearly one of the most fundamental characteristics of any testing and conformity assessment procedure and therefore can be said to affect the marketing or use of the products concerned.
