Memorandum submitted by the Hong Kong Economic and Trade Office

  I refer to your letter of 10 July.

  Of the three "suspended" ordinances, we have amended the Trade Unions (Amendment) No. 2) Ordinance, repealed the Employment (Amendment) (No. 4) Ordinance 1997 on anti-union discrimination in employment and the Employees' Right to Representation, Consultation and Collective Bargaining Ordinance.

  As regards the other two "unfrozen" ordinances, we have amended the Employment Ordinance to defer making 1 May a statutory holiday to 1999 and to give effect to the results of the Administration's review on the provisions on statutory holidays. We have also amended the Occupational Deafness (Compensation) Ordinance to give effect to the results of the Administration's review of the Occupational Deafness Compensation Scheme.

  The Bill of Rights (Amendment) Ordinance 1997 was repealed in January this year.

  I attach several papers to explain the background of the following changes:

    (a)  the suspension of the five labour-related ordinances (Annex A);

    (b)  the decision to repeal two and amend one of the three suspended ordinances (Annex B); and

    (c)  the decision to repeal the Bill of Rights Ordinance (Annex C).

  I also enclose at Annex D statistics on the Private Members' Bills introduced into the Legislative Council since 1990/91.
