The Lord Chancellor's
Advisory Group on Ancillary Relief
The Advisory Group commenced as an informal
Working Party looking at the systems in place for dealing with
ancillary relief cases. The Working Party was chaired by Lord
Justice Thorpe (then Mr Justice Thorpe) and its membership is
made up of members of the judiciary, legal profession and academics.
In August 1995 the Working Party became the
Lord Chancellor's Ancillary Relief Advisory Group whose terms
of reference are to advise the Lord Chancellor on all aspects
of ancillary relief including any issues which may arise concerning
the substantive law. The main focus of the Group's work has been
on procedural issues, and the Group are currently overseeing the
progress of a Pilot Scheme which is designed to increase judicial
involvement in the early stages of ancillary relief claims, and
to focus parties, and practitioners on the issues.
They have been involved in advising the Lord
Chancellor on issues relating to ancillary relief in relation
to pension sharing on divorce.
