    '(2A) In any case where—

      (a) a best value authority makes written representations to the Secretary of State requesting him to exercise any of his powers under subsection (1) or (2) above or under Schedule (Energy Conservation and Efficiency Measures) in such manner and to such extent as is specified in the request, and

      (b) at least 50 best value authorities make written representations to the Secretary of State supporting (expressly or by implication) that request,

    then if the Secretary of State does not lay a draft of the order giving effect to that request within 3 months of the date on which he received the 50th representation referred to in paragraph (b) above, he shall instead within 4 months of that date lay a report before both Houses of Parliament setting out his reasons for not complying with the request.'.
