Proposal for tax-varying powers

To move the following Clause:—

    '(1) The Greater London Authority shall be empowered to adopt proposals for greater financial autonomy with tax-varying powers by a two-thirds majority vote of the Assembly.

    (2) Before implementing proposals for greater financial autonomy with tax-varying powers, a referendum of those entitled to vote in ordinary elections shall be held in which a simple majority of those voting shall be required to allow the tax-varying proposals to be implemented.'.

To move the following Clause—

    ' —(1) Where a billing authority which is a London Borough Council or the Common Council serves a notice on a liable person stating the chargeable amount or its estimated amount of council tax in respect of which the liable person is liable to pay council tax to that billing authority for a financial year, the notice shall be by way of at least two documents, of which—

      (i) one document shall state the element of that amount which arises as a result of the precept issued by the Authority but not any other element of that amount or the total of that amount; and

      (ii) one other document shall state the remaining element of that amount but not the total of that amount.

    (2) The documents referred to in subsection (1) of this section shall, where they comprise one notice, be served in one single envelope or other enclosure.

    (3) In this section—

          "billing authority" has the same meaning as in the Local Government Finance Act 1992;

          "council tax" has the same meaning as in the Local Government Finance Act 1992;

          "precept" has the same meaning as in the Local Government Finance Act 1992;

          "liable person" has the same meaning as in Schedule 7 to the Local Government Finance Act 1992.'.


Notice of Greater London Authority precept

To move the following Clause:—

    '(1) Section 14 of the Local Government Finance Act 1992 (Administration, penalties and enforcement) shall be amended as follows.

    (2) After subsection (1) there shall be inserted—

    "(1A) A billing authority in Greater London shall, in respect of council tax for each financial year, indicate on any notice served on a liable person the amount chargeable as a result of any precept set by the Greater London Authority.

    (1B) Any reference in this Section to a liable person is a reference to a person who is solely liable to pay to the authority, in respect of a particular dwelling, an amount in respect of council tax for a financial year, and includes a reference to a person who in the opinion of the authority will be so liable.".'.


Limitation of precepts

    'Chapter IVA of the Local Government Finance Act 1992 (limitation of council tax and precepts), as inserted by Schedule 1 to the Local Government Act 1999, shall not apply to the Greater London Authority.'.


Council Tax Band I for London

    '(1) Section 5 of the Local Government Finance Act 1992 shall be amended as follows.

    (2) At the beginning of subsection (1) there shall be inserted "Subject to subsection (1A)."

    After subsection (1) there shall be inserted—

      "(1A) The amounts of council tax payable in respect of dwellings situated in the same London borough's area or the Common Council's area (or the same part of such an area) and listed in different valuation bands shall be in proportion—

           6: 7: 8: 9: 11: 13: 15: 18: 35

           where 6 is for dwellings listed in valuation band A. 7 is for dwellings listed in valuation band B, and so on.

      (1B) Subsection (1A) above shall not apply for the purpose of calculation of any authority's tax base."

    (3) At the beginning of subsection (2) there shall be inserted "Subject to subsection (2A)."

    (4) After subsection (2) there shall be inserted—

      "(2A) The valuation bands for dwellings in Greater London are set out in the following Table—
