Transport functions of the Mayor

To move the following Clause:—

    (1) the Mayor—

      (a) shall keep under review the matters which may be expected to affect the transport facilities and services mentioned in section 122(1) above; and

      (b) may, if he thinks fit, at any time institute a fresh survey of Greater London examining those matters.

    (2) Without prejudice to the generality of subsection (1), the matters to be kept under review and examined under that subsection shall include—

      (a) the principal physical and ecomomic characteristics of Greater London and, so far as they may be expected to affect that area, of any neighbouring areas;

      (b) the size, composition and distribution of the population of Greater London (whether resident or otherwise);

      (c) without prejudice to paragraph (a), the communications, transport system and traffic of that area, of any neighbouring areas;

      (d) any considerations not mentioned in paragraph (a), (b) or (c) which may be expected to affect any matters so mentioned;

      (e) such other matters as may be prescribed or as the Secretary of State may in a particular case direct;

      (f) any changes already projected in any of the matters mentioned in any of the previous paragraphs and the effect which those changes are likely to have on the transport strategy.

    (3) A survey under subsection 1(b) may relate to only part of Greater London; and references in subsection (2) to Greater London or any neighbouring areas shall be construed accordingly.

    (4)     The Mayor shall, for the purpose of discharging his function under this section of examining and keeping under review any matters relating to another local authority, shall consult that other authority about those matters.'.


Duty of Mayor to consult on transport strategy

To move the following Clause:—

    ' (1) When preparing proposals for the creation, revision, whether pursuant to a direction of the Secretary of State or otherwise, or repeal and replacement of a transport strategy and before finally determining its content the Mayor shall take such steps as will in his opinion secure—

      (a) that adequate publicity is given in Greater London to the matters which he proposes to include in the transport strategy;

      (b) that persons who may be expected to desire an opportunity of making representations to the authority with respect to those matters are made aware that they are entitled to an opportunity of doing so;

      (c) that such persons are given an adequate opportunity of making such representations; and

      (d) that copies of the transport strategy are available for inspection.

    (2) The Mayor shall consider any representations made to him.'.


Local inquiries

To move the following Clause:—

    '6(1) The London borough council may cause a local inquiry or other hearing to be held for the purpose of considering objections to their proposals for the making, alteration, repeal or replacement of a local implementation plan.

    (2) It shall hold such a local inquiry or other hearing in the case of objections made in accordance with regulations unless all the persons who have made such objections have indicated in writing that they do not wish to appear.

    (3) A local inquiry or other hearing shall be held by a person appointed by the Secretary of State or, in such cases as may be prescribed, by the London borough council itself.

    (4) Regulations may—

      (a) make provision with respect to the appointment, and qualifications for appointment, of persons to hold a local inquiry or other hearing;

      (b) include provision enabling the Secretary of State to direct a London borough council to appoint a particular person, or one of a specified list or class of persons;

      (c) make provision with respect to the remuneration and allowances of the person appointed.

    (5) Subsections (2) and (3) of section 250 of the Local Government Act 1972 (power to summon and examine witnesses) apply to an inquiry held under this section.

    (6) The Tribunals and Inquiries Act 1971 shall apply to a local inquiry or other hearing held under this section as it applies to a statutory inquiry held by the Secretary of State but as if in section 12 (1) of that Act (statement of reasons for decisions) the reference to any decision taken by the Secretary of State were a reference to a decision taken by a London borough council.'.


Ticketing

To move the following Clause:—

    '(1) With effect from the appointed day, Transport for London shall introduce, or procure or facilitate the introduction of, a means by which passengers shall be able to make journeys in Greater London using more than one public passenger transport service having purchased only a single ticket, such ticket be a voucher or an electronic card or such other system as appears to Transport for London to be the most reliable, economic and efficient means to effect such journeys.

    (2) The Mayor may issue regulations under this subsection as to the day on which subsection (1) above shall come into effect, provided that the appointment day within that subsection shall be no later than the fifth anniversary of this Act coming into force.'.


Transport for London public access offices

To move the following Clause:—

    '(1) Transport for London shall have the duty to maintain at least one office (referred to in this section as a "public access office") in each London borough where members of the public shall be able to obtain information concerning transport facilities to, from and within Greater London.

    (2) The information available at a public access office shall include, but shall not be limited to, the frequency of services within the London bus network, the location of stopping places in Greater London, the frequency of railway services within Greater London, the location of railway stations in Greater London, and information allowing passengers to transit from one public passenger transport service to another.

    (3) Each public access office shall be open for at least twelve hours each day of the week (including Sundays and bank holidays).

    (4) Transport for London shall—

      (a) ensure that members of the public are able to contact any public access office by means of a telephone call at no cost to the public, or by telephone facsimile; and

      (b) ensure that the information available at any public access office is also published electronically in a form capable of access by members of the general public.

    (5) Transport for London shall ensure that each public access office is capable of easy access and exit by people with any disability.

    (6) In this section "London bus network" and "stopping place" have the meanings given in Chapter IV of this Part.'.


Publication of Notices by Mayor

To move the following Clause:-

    'On receipt of any notice pursuant to section 43(1) of the Railways Act 1993 the Major shall publish the notice in at least two newspapers circulating in the entire area of Greater London, and also publish it electronically in a form capable of access by members of the public.'.


Collection and holding of Londoners' Money Fund

To move the following Clause:—

    '(1) The Mayor may by regulations make provision for the collection and holding of the Londoners' Money Fund, including a system of controls to ensure that no part of it is expended in any manner which is not a qualifying purpose.

    (2) No regulations made pursuant to subsection (1) above shall come into effect until they are approved by the Assembly.'.


Financial Statements

To move the following Clause:—

    '(1) There shall be presented by the Londoners' Money Trustees to the Assembly each year financial statements for the Londoners' Money Fund (prepared according to generally accepted principles of accounting) audited by external auditors.

    (2) The Assembly shall fix the appointment and remuneration of the external auditors referred to in subsection (1) above.

    (3) The financial statements referred to in subsection (1) above shall be available at no charge to members of the public and published electronically by the Mayor in a form capable of access by members of the public.'.


Londoner's Money Fund

To move the following Clause:—

    '(1) Londoners' Money shall not form part of the consolidated Fund but shall instead be paid into a separate fund (in this Chapter known as "the Londoners' Money Fund") controlled by the Mayor acting with a representative selected by the Assembly and a representative selected by the London borough councils (together in this Part known as "the Londoners' Money Trustees").

    (2) Payments from the Londoners' Money Fund may only be authorised by a relevant person for a qualifying purpose.

    (B) A qualifying purpose within the meaning this Part is:

      capital expenditure to improve the provision of public passenger transport services in Greater London

      capital expenditure on the promotion, encouragement and provision of safe, efficient and economic transport facilities and services to, from and within Greater London,

      in respect of penalty fares paid pursuant to regulations issued under section 170(1) of this Act, to defray the expenses of Transport for London,

      payment by Transport for London to the operator of any public passenger transport service in order under a contract entered into to secure the provision of that service

      the repayment of debt incurred by Transport for London,

      payments authorised under regulations issued under section 200(1) of the Act

      payments authorised under regulations issued under section 201(1) of this Act and

      payments or rebates under regulations issued under section a (Promotion of the use of the River Thames for transport proposals) (1) of this Act.

    (4) A relevant person within the meaning of this section is any person or body required to discharge any function or duty under this Part, including the Londoners' Money Trustees acting together.'.
