NEW CLAUSES RELATING TO PART IX

Directions under the Environment Act 1995

To move the following Clause:—

    '.—(1) Section 85 of the Environment Act 1995 (reserve powers of the Secretary of State in relation to air quality) shall be amended in accordance with subsections (2) to (4) below.

    (2) In subsection (1) (definition of "appropriate authority" for the purposes of the section)—

      (a) in paragraph (a), for the words "England and Wales, the Secretary of State; and" there shall be substituted the words "local authorities in England and Wales other than local authorities in Greater London, the Secretary of State;", and

      (b) after that paragraph there shall be inserted—

            "(aa) in relation to local authorities in Greater London, the Mayor of London; and".

    (3) After subsection (5) (power of the Secretary of State to give directions relating to obligations under the Community Treaties or to international agreements) there shall be inserted—

            "(5A) Subsection (5) above has effect in relation to local authorities in Greater London as if the reference to the Secretary of State were a reference to the Mayor of London.

            (5B) The powers of the Mayor of London to give directions under this section to a local authority in Greater London may only be exercised after consultation with the local authority concerned.

            (5C) In exercising any function under subsection (2), (3) or (4) above, or subsection (5) above by virtue of subsection (5A) above, the Mayor of London shall have regard to any guidance issued by the Secretary of State to local authorities under section 88(1) below."

    (4) After subsection (6) (publishing of directions under the section) there shall be inserted—

            "(6A) The Mayor of London shall send a copy of any direction he gives under this section to the Secretary of State."

    (5) In section 122(3) of the Environment Act 1995 (directions given under the Act relating to obligations under the Community Treaties) after "any direction" there shall be inserted ", other than a direction given by the Mayor of London,".'.


Impact of ambient noise strategy on airport capacity

Water action plan

To move the following Clause:—

    '242A—(1) The Mayor shall produce and publish a report to be known as the "water action plan for Greater London".

    (2) The report required of the Mayor under subsection (1) shall be published—

      (a) in the case of the first report within a period of one year from the date of the first ordinary election

      (b) in the case of each subsequent report before the end of the period of two years beginning with the day on which the previous report was published

      (c) these reports shall be published at no charge on the GLA website.

    (3) A water action plan for Greater London shall contain information about the following matters in relation to Greater London—

      (a) water quality and emissions to water from industrial sources

      (b) water quality and emissions to water from non-industrial sources

      (c) ground water levels

      (d) river levels

      (e) reservoir levels relating to the total supply of water to Greater London

      (f) the disposal of sewage and waste water

      (g) the treatment of sewage and waste water

      (h) sea level rise

      (i) the industrial, transport and recreational uses of the River Thames and may contain all other matters deemed relevant by the Environment Strategy Group.

    (4) Before producing a water action plan for Greater London, the Mayor shall consult—

      (a) the Environment Agency

      (b) each London borough council

      (c) the Common Council

      (d) the Environment Strategy Group

      (e) English Nature

      (f) the appropriate privatised water utilities.

    (5) The water action plan shall also contain—

      (a) the water quality and the predicted future water quality in Greater London

      (b) the measures to be taken by the Authority for the implementation of a water strategy

      (c) the measures which are to be taken by other persons or bodies in section 4 to implement the water action plan

      (d) a summary of action to be taken by the Mayor for the purpose of promoting measures to improve and enhance water provision for Greater London.

    (6) In exercising any function as a water provider or user a local authority or other relevant body shall have regard to the water action plan for Greater London.'.
