Mayor to nominate members of certain boards

    'With the approval of the Assembly, the Mayor may nominate a member to the board of each of the following bodies:

      (a) the London Arts Board;

      (b) the South Eastern Museums Service, or its successor or bodies;

      (c) the London region of the Sports Council; and

      (d) the London region of English Heritage.'.


NEW SCHEDULE RELATING TO PART X

To move the following Schedule:—

'Tourism for London

Membership

    1.—(1) Tourism for London shall consist of such number of members as the Mayor may from time to time determine.

    (2) The members shall be appointed by the Mayor.

    (3) The members shall be individuals—

      (a) who are representatives of such bodies concerned with relevant matters as the Mayor considers appropriate; or

      (b) who have knowledge, experience or expertise which is relevant to the functions of Tourism for London.

      (4) Before making any appiontment of a member, the Mayor shall consult such bodies or persons as he considers appropriate.

    (5) Before making an appointment by virtue of sub-paragraph (3)(a) above, the Mayor shall consult the body concerned.

      (6) In sub-paragraph (3)(a) above "relevant matters" means any of the matters in relation to which the culture strategy may contain policies.

Chairman

    2.—(1) Tourism for London shall at each annual meeting appoint a chairman from amongst its members.

    (2) The appointment under sub-paragraph (1) shall be the first business transacted at the meeting.

    (3) On a casual vacancy occurring in the office of chairman, an appointment to fill the vacancy shall be made—

      (a) at the next meeting of Tourism for London, or

      (b) if that meeting is held within fourteen days after the date on which the vacancy occurs and is not an annual meeting, not later than the following meeting.'.

Tenure of office

    3.—(1) The members of Tourism for London shall hold and vacate office in accordance with the terms of their appointment.

    (2) A person shall be appointed to hold office as a member for—

      (a) a term of four years or a term expiring on his attaining the age of seventy years, whichever is the shorter, or

      (b) such shorter terms as the Mayor may determine in any particular case.

    (3) The Mayor may at any time, by giving notice to a member of Tourism for London, terminate the member's appointment, if he is satisfied that the member is unable or unfit for any reason to discharge his functions as a member.

    (4) A member may at any time resign his membership by giving notice to the Mayor.

    (5) A person who ceases to be a member shall be eligible for re-appointment.

Members' expenses

    4.—(1) The Mayor may pay the members of Tourism for London such remuneration as he considers appropriate and allowances in respect of travel or other expenses properly incurred by them.

    (2) When the Mayor determines any such remuneration he shall report it to the Assembly in writing.

Staff

    5.—(1) Tourism for London may appoint such staff as it considers necessary for assisting it in the exercise of any of its functions.

    (2) The staff of Tourism in London shall be appointed on such terms and conditions (including conditions as to remuneration) as Tourism for London shall determine.

Financial Provisions

    6. The Mayor may provide Tourism for London with sums of money towards defraying expenses properly incurred by them in carrying out their functions.

Proceedings

    7.—(1) The quorum of Tourism for London and the arrangements relating to their meetings shall be such as they may determine.

    (2) The validity of proceedings of Tourism for London is not affected by any vacancy among the members or any defect in the appointment of any member.'.


REMAINING NEW CLAUSES

Companies in which local authorities have interests

To move the following Clause:—

    '.—(1) In Part V of the Local Government and Housing Act 1989 (companies in which local authorities have interests) section 67 (application of, and orders under, the Part) shall be amended as follows.

    (2) In subsection (3) (which specifies the bodies which are local authorities for the purposes of the Part) after paragraph (b) there shall be inserted—

            "(bb) the Greater London Authority;

            (bc) a functional body, within the meaning of the Greater London Authority Act 1999;".'.


Greater London Regional Health Authority

To move the following Clause:—

    '.—(1) There shall be a body corporate to be known as the Greater London Regional Health Authority.

    (2) The Greater London Regional Health Authority shall have the functions conferred or imposed on it by this or any other Act, or made exercisable by it under this Act, and any reference in this Act to the functions of the Greater London Regional Health Authority includes a reference to any functions made exercisable by this Act.

    (3) The Greater London Regional Health Authority shall exercise its functions—

      (a) in accordance with such guidance or directions as may be issued to it by the Mayor under section ( ) below,

      (b) for the purpose of facilitating the discharge by the Authority of the duties under this Act, and

      (c) for the purpose of securing and facilitating the implementation of the health strategy.

    (4) The Authority may issue to the Greater London Regional Health Authority

      (a) guidance as to the manner in which it exercises its functions,

      (b) general instructions as to the manner in which it is to exercise its functions, or

      (c) specific instructions as to the exercise of its functions.'.


Report on health impact of strategies

    '(     ) The Mayor shall produce and publish reports of the impact on the health of persons in Greater London of the strategies set out in subsection 33(1).'.


Equality of opportunity

    '(1) The Authority shall make appropriate arrangements with a view to securing that its functions are exercised with due regard to the principle that there should be equality of opportunity for all people.

    (2) After each financial year the Authority shall publish a report containing—

      (a) a statement of the arrangements made in pursuance of subsection (1) which had effect during that financial year, and

      (b) an assessment of how effective those arrangements were in promoting equality of opportunity.'.


EU Committee of the Regions

    'The Assembly shall elect two of its members to be amongst the representatives from Greater London to be included in the Committee of the Regions of the European Union.'.

Private bills

To move the following Clause:—

    '(1) The Authority may promote private bills in Parliament and may oppose any private bill in Parliament.

    (2) But the Authority shall not promote or oppose any private bill in Parliament unless a motion to authorise the Authority to promote or oppose the bill is passed by the Assembly on a vote at least two-thirds of the Assembly members voting support the motion.

    (3) Subsection (1) shall not cause the Authority to have power to apply for orders under section 1 or 3 of the Transport Works Act 1992 by virtue of section 20 of that Act (which gives a body with power to promote and oppose private bills power to apply for and object to such orders).'.


National Health Service

    '( ) The Secretary of State shall, within a period of six months of the inception of the Authority, issue guidance to the Authority with respect to a funded mandate for it in relation to the National Health Service in London.'.


Greater London warm homes strategy

To move the following Clause:—

    '(1) The Mayor, with the approval of the Assembly by simple majority, shall produce and publish a document to be known as the Greater London Warm Homes Strategy.

    (2) The Mayor, with the approval of the Assembly by a simple majority, may revise the Greater London Warm Homes Strategy from time to time as considered appropriate and in such cases he shall publish the strategy as revised.

    (3) The Greater London Warm Homes Strategy and any revisions thereof shall consist of the Mayor's proposals and policies for the eradication of fuel poverty in Greatear London over a period of not more than five years.

    (4) In preparing or revising the Greater London Warm Homes Strategy, the Mayor shall have regard to any plans or action taken or proposed ot eradicate or alleviate fuel poverty in Greater London by—

      (a) the Secretary of State;

      (b) London borough councils and the Common Council; and

      (c) any health authority or NHS trust covering Greater London.

      (5) in preparing or revising the Greater London Warm Home Strategy, the Mayor shall consult—

      (a) London borough councils;

      (b) the Common Council; and

      (c) such persons as appear to him to be interested in the eradication of fuel poverty in Greater London.

    (6) In taking any action to eradicate or alleviate fuel poverty in its area a London borough council and the Common Council shall have regard to the Greater London Warm Homes Strategy.

    (7) For the purposes of this section—

      "fuel poverty" means the situation where a household is spending ten per cent. or more of its disposable income on keeping warm. "Warm" means living room temperatures of no less than 18 degrees celsius and a temperature of no less than 16 degrees celsius in the remainder of the accommodation.'.
