Punishments

To move the following Clause:—

    '.—(1) Schedule 2 (punishments, etc) of the Sexual Offences Act 1956 is amended as follows.

    (2) In sub-paragraphs (a) and (b) of paragraph 3 (buggery)—

      (a) for the word "sixteen" there shall be substituted the word "thirteen"; and

      (b) for the words in the third column (punishment) there shall be substituted the words "Two years.".

    (3) In sub-paragraphs (a) and (b) of paragraph 16 (indecency between men) for the words in the third column (punishment) there shall be substituted the words "Two years.".


Notification requirements

To move the following Clause:—

    '( ) In section 1 (sex offenders subject to notification requirements) of the Sex Offenders Act 1997, there shall be inserted the following subsection—

            "(4A) Notwithstanding the provisions of this section, a person subject to the notification requirements of this Part by reason of an offence which ceases to be an offence after the commencement of section 1 of the Sexual Offences (Amendment) Act 1999 (reduction in age at which certain sexual acts are lawful) shall no longer be subject to those notification requirements after the commencement of that section.".'.

*To move the following Clause:—

    '( ) After section 13 of the Sexual Offences Act 1956 (indecency between men) there shall be inserted the following section—

"Exceptions

13A.—(1) A man (A) is not guilty of an offence under section 12 or 13 above against another man (B) under the age of sixteen, if A is under the age of twenty four and has not previously been charged with a like offence, and he believes B to be of the age of sixteen or over and has reasonable cause for belief.

    (2) In this section, 'a like offence' means an offence under section 12 or 13 above or an offence under the Sexual Offences (Amendment) Act 1999.".'.


Homosexual Offences (Northern Ireland) Order 1982

*To move the following Clause:—

    '( ) In Article 3 of the Homosexual Offences (Northern Ireland) Order 1982 (homosexual acts in private), at the end there shall be inserted—

    "( ) A man (A) is not guilty of an offence of doing a homosexual act with another man (B) where B is under the age of 17, if A is under the age of 25 and has not previously been charged with a like offence, and he believes B to be of the age of 17 or over and has reasonable cause for the belief.".'.
