    that section shall apply as if the reference had been a reference made by the organisation under subsection (1) of that section.

    (1B) For the purposes of subsection (1A) above, a reference of an individual for inclusion in that Index is determined only when, following the reference—

      (a) the individual is included (otherwise than provisionally) in the Index; or

      (b) the Secretary of State determines that he should not be included in it.'.

Failure to inform prospective employer of presence on list

    '.—(1) Any individual who knows that he is included in the list kept by the Secretary of State under section 1 shall be guilty of an offence if he applies for employment in a child care position but fails to inform his prospective employer that he is on the list.

    (2) Any individual guilty of an offence under subsection (1) above shall be subject to a maximum term of imprisonment of three months.'.


Code of practice for screening of specified persons

Duty to inform social services

    'Whenever the Secretary of State provisionally includes an individual in the list in accordance with section 2(3)(b) above or confirms the inclusion of an individual in the list in accordance with section 2(5) above or removes an individual from the list in accordance with section 1(3) above, he shall, within a period of 30 days after such inclusion, confirmation or removal, inform the Social Services Department responsible for the area in which the individual resides of such inclusion, confirmation or removal.'.
