Require energy conservation authorities to draw up reports concerning fuel poverty and to designate officers with responsibility for energy conservation; and for related purposes.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Eradication of fuel poverty and designation of energy conservation officers.     1. - (1) The Home Energy Conservation Act 1995 is amended as follows.
 
      (2) In subsection (1) of section 1 (interpretation), after the definition of "energy conservation measures" there is inserted-
 
 
    ""fuel poverty" means the expenditure by a household of 10 per cent or more of its income on maintaining an ambient temperature in its main living area of at least 18 degrees centigrade and in its other main accommodation of at least 16 degrees centigrade;".
      (3) After subsection (3) of section 2 (energy conservation reports) there is inserted the following subsection-
 
 
    "(3A) The report shall also include a section which gives-
 
 
    (a) an assessment of the extent and nature of fuel poverty in the authority's area;
 
    (b) the authority's proposals for eradicating fuel poverty in its area; and
 
    (c) an assessment of the effects of any steps already taken by the authority towards eradicating fuel poverty in its area.".
      (4) After section 5 (modification of report and further reports) there is inserted the following section-
 
 
"Designation of officers.     5A. An energy conservation authority shall designate one or more officers to discharge its functions under this Act.".
 
Expenses.     2. There shall be paid out of moneys provided by Parliament any increase attributable to this Act in the sums payable out of such moneys under any other Act.
 
Short title.     3. This Act may be cited as the Fuel Poverty and Energy Conservation Act 1999.
