Veterinary inspection of animals for international transport.     5. - (1) At the end of sub-paragraph (ii) of paragraph (1) of article 9 of the 1981 Order there is inserted the words "and free from disease".
 
      (2) After paragraph (1) of article 9 of the 1981 Order there is inserted the following new paragraphs-
 
 {d3} (a) shall nominate a veterinary inspector in respect of each consignment of animals for transportation; but{d3} (b) shall not nominate a veterinary inspector who provides other veterinary services to the exporter.{d3} (a) shall spend sufficient time inspecting each animal to ensure that it is fit to travel and free from disease; and{d3} (b) shall inspect no more than-
    "(1A) The Minister-
 
      (1B) In discharging his functions under paragraph (1) above the veterinary inspector-
 
 
      (i) 50 animals other than lambs, or
 
      (ii) 100 lambs
 
    in any period of one hour.".
Veterinary inspection of animals for transport to another member State.     6. After paragraph (4) of Regulation 5 of the 1995 Regulations there is inserted the following new paragraphs-
 
 
    "(4A) In appointing a veterinary inspector for the purposes of paragraph (1)(b) above the Minister-
 
 
    (a) shall nominate a veterinary inspector in respect of each consignment of animals for export or consignment; but
 
    (b) shall not nominate a veterinary inspector who provides other veterinary services to the exporter or consignor.
      (4B) In discharging his functions under paragraph (1)(b) above the veterinary inspector-
 
 
    (a) shall spend sufficient time inspecting each animal to ensure that it is fit to travel and free from disease; and
 
    (b) shall inspect no more than-
 
      (i) 50 animals other than lambs, or
 
      (ii) 100 lambs
 
    in any period of one hour.".
Powers of entry and inspection.     7. After section 64A of the Animal Health Act 1981 there is inserted the following new section-
 
 
"Powers of inspectors relating to monitoring of animals.     64B. In addition to the powers conferred by sections 63 and 64, an inspector (on producing, if required to do so, some duly authenticated document showing his authority) may at all reasonable hours-
 
    (a) enter-
 
      (i) any land, building, or other place, or
 
      (ii) any vessel, boat, aircraft, hovercraft or vehicle of any other description,
 
    for the purpose of monitoring the health and welfare of any animals therein or thereon, and
 
    (b) carry out such inspections as may be necessary for that purpose.'".
Report to Parliament.     8. No later than 31st December 1999 the Ministers shall lay before Parliament their proposals-
 
 
    (a) for ending the export for slaughter or production of live farm animals from Great Britain to other member States of the European Union;
 
    (b) for prohibiting the transport for slaughter or production of live farm animals over long distances between member States of the European Union; and
 
    (c) for requiring, wherever practicable, the slaughter of farm animals before transport between member States of the European Union.
Short title and commencement.     9. - (1) This Act may be cited as the Transport of Farm Animals Act 1999.
 
      (2) This Act shall come into force at the end of the period of 3 months beginning with the day on which it is passed.
